2/ How many years left to run on mortgage

3/ Approx how much equity in the house

4/ What you offered off the arrears yesterday

Does anyone know if you can draw on a pension for mortgagelink3.gif arrears? Can't borrow off employer as husband only been there a few weeks.

 

Hello there.

 

To add to what Ell-enn has said, you can't borrow from the pension fund as far as I know. You would probably need to take the pension and tax-free cash option, which could be available from age 55, as Ell-enn says.

Ok thanks for the link.

They have so far offered £ 2000 back and to stop putting the £40 per month charge.

 

But when I spoke to GE yesterday,

I had to confirm the cmi.

 

In court ge's solicitor said is was £1059 when asked by the judge,

but they said to me if I want to make sure I'm covering the full monthly instalment it's £1116.

 

On my second account I want to pay £100 per month off arrears,

but if ge charge me the standard £40 charge plus £57 in interest,

I'll only be putting £3 towards arrears,

I'm so confused :(

The £40 charge is now frozen isn't it?

 

The £2000, is that all of the arrears or just something they have offered as a goodwill gesture?

Morning your up early

 

The charges are unfair and you should demand all of them back and stop the automatic charge being added to the account every month. If they won't refund ALL of the charges then tell them you will be complaining to the Financial Ombudsman. Do this by letter, keep all correspondance in writing.

Thanks for your continued support. Ok I will write to GE and go from there.

The added problem i have though, is the fact they add these charges onto my cmi, so every few months the instalment goes up. They said it's so I don't have a big bill to address at the end of the mortgage term ( how thoughtful!!)

So my cmi is £1059 and ge have demanded that I pay £1116.

I am working a couple of nights and sneak on here when I can. Once they refund the charges and freeze all others the repayment should be lower. The charges are unfair whether they are on the mortgage total or the arrears.

The amount you owe in arrears is added to your total mortgage. As a result, your monthly payments will go up. Repayment of the arrears is spread over the rest of your mortgage. Don't forget there is interest on these extra amounts daily.

That is not treating the customer fairly, claim them back when you can. If it helps there are some case studies here the Ombudsman have been involved in:

So pleased for you,and that you have had such a positive experience! I'm not coping very well,anxiety is through the roof,and I have a million thoughts going through my head.:sad: mainly about our court day,and that we will get a bastard of a judge who will laugh at us, sounds silly I know! Its in 2 weeks time so with the help of ell-enn (really dont know what I'd do without her) I'm preparing my defense letter,so will feel better when I have sent that off, just a waiting game now! sending you peace and calm thoughts!:peace:

It seriously will be fine. Try to stop panicking, easier said than done I know, but you will be ok.

I don't know what the judge will say when I go back. But we have made a few positive moves so I'm hoping it will go ok. He won't laugh at you. They are not on anyone's side, they listen to the facts and make a fair decision.

and for that I wish you every sucess and best wishes for xmas.

 

To further lift your spirits,

I would suggest once you have these current issues stabilised that you get in touch with claims management company specialising in mis-sold mortgages.

 

From the snipets you have posted early on in this thread you clearly have a case.

I know that these companies usually operate a no win-no fee system, that means it does not cost you anything.

 

However, they will only take on a sure thing.

 

By way if example for you as to what may be acheived in a mis-sold event, a recent case I was involved in saw the borrower acheiving a 75% reduction on their borrowed amount.

 

What this means in simple terms is the amount borrowed at the date of loan was reset to 75% of the value,

interest was recalculated on the revised loan amount and this total deducted from the Borrowers cmi payments and the balance refunded to the Borrower.

Imagine all your money back. Oh, and the Lender was responsible for the costs which were substantial.

 

Now you will not find any case law to support this as the Lenders will not let it get into court for fear of a decision being published, no they could not afford that.

 

as I say, get the current issue out of the way, go see a claims management co., get these people of your back and get some payback.

Oh and remember you are not to blame for any of this.
