  1. Hello I've send them a mail requesting a a full refund and explaining them why I want a full refund. They are claiming that on the phone I've told them the wrong tyre size. I'm assuming they are recording all phone calls and can I request under Right of Access that they have to send over to me that recording of my phone call? All the best
  2. Hello @theberengersniper I've used a Visa Debit card so chargeback is the only way since Section 75 doesn't cover debit cards.
  3. A friend lent me her car, but shortly after, I got a flat tyre. Since she was on vacation, I searched on Google and found a service called Rescue Mate (https://rescuemate.co.uk/). I called them at 12:30 and provided them with the exact tire size while I sat in front of the flat tire. They quoted me a price of £220, which I found to be quite high, but I went ahead and gave them my credit card information. They informed me that a tyre fitter would arrive within 60-90 minutes. However, even after three hours and three phone calls, the fitter still hadn't shown up. Eventually, the fitter called me, and he turned out to be a local subcontractor. He explained that Rescue Mate had scheduled me for a service between 3-4 PM. Although I was angry about the delay, I was relieved that the fitter was finally on his way to replace the tyre. After 25 minutes, he arrived but discovered that Rescue Mate had provided him with the wrong tyre size. I immediately called Rescue Mate, and they claimed that I had given them the incorrect tyre size, stating that I would have to pay for another delivery. However, I had a passenger with me who witnessed the call and heard me provide the correct tyre size. I was surprised and frustrated by their response. Before I could say anything, they added that they didn't currently have the correct tyre size in stock and couldn't deliver it to me that day. They offered to refund me the money, minus the fitter's journey cost. Feeling ripped off and frustrated by their refusal to take responsibility, I ended the call. I spoke to the fitter about the situation, and he mentioned that issues like this were common with Rescue Mate. However, my main concern was getting the tyre replaced. I asked him if it was true that he couldn't bring me another tyre, and he confirmed that wasn't the case. He could provide one within 1-2 hours for £135. I agreed, and his colleague arrived and replaced the tyre five hours after my initial call. Rescue Mate refunded me only £80 out of the £220 I had paid. I want the remaining £140 back. Now I'm wondering if I should take this matter to Small Claims court or file a Charge Back and send it to VISA. I don't appreciate them putting the blame on me and expecting me to pay for their mistake. It's unfair that I should be charged for something when they clearly failed to deliver what they promised.

  6. Kysanto I've already won against EVRi in SC court with the help of this forum. The whole afternoon I saw planes flying and the weather was fine. I remember because it was the exact same hour the queen died. BA already paid me this year because of a cancelled flight in spring..they don''t want to pay me again and tomorrow I'm flying BA again. I will start the process
  7. Thanks for the info but this only works if what BA is claiming (bad weather) is true. According to Kyosanto who provided the weather report for that day at that time for LHR airport there was no bad weather. For me they are just claiming lies so that they don't have to pay me.

These situations include: Sudden storms or gusts of wind Wintery conditions or poor visibility Air traffic control restrictions Airport is at capacity Because these types of events are outside of the airline’s control, they’re considered to be extraordinary circumstances, and airlines aren’t required to pay compensation for them. Next step would be to submit a claim.
  9. Ah thanks BankFooder, I've added it to my index page and added it to my witness sceleton. Is there anything I have to add? Should I send the paper over via mail to EVRi or is it enough to send it to the email adress which was provided by EVRi solicitor in their defense?   10. Hello BankFodder, I've downloaded relevant parts of the consumer rights acts and saved them. I created a table and numbered all of them. I filled out the sceleton template with those numbers where XX was written and filled out any other information. One last thing though: at the end at point 26 there is a sentence: "Finally, I have included at the end of my court bundle, page xx, a non-exhaustive list of reasons as to why the Defendant’s insurance requirement is unfair" How can I made this "non-exhaustive list" of reasons?   12. Hello BankFodder, I'm battling with depression and I couldn't motivate myself to write up the statement and collect all the papers. I've done that now and I've wrote the index file too. I will drop it off at the court later today and I was planning to send it via email to EVRi today and send it via next day delivery today too just to be sure. I thought that would be enough?

  15. Hello everybody, long story short EVRi delivered my parcel with its item stolen. It was insured, they denied my insurance claim and I send them a money claim and answered that with a shitty answer. They didn't bother with mediation and I received a court order where I was ordered to send a witness report to the judge and to the other side. The deadline is Tuesday 4pm. I can leave it in person at the court but I can't go to Leeds to deliver it in person. When I send it with first class next day delivery tomorrow morning it will arrive on wednesday according to this: https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part06#6.26 How can I make sure that EVRi gets the witness statement in time? Can I send the witness statement via email to the email adress of the solicitor who answered in the defendants response? doodoo I should've taken care sooner of this but it was such a disappointing doodoo show there is not much fight in me left Any advice much appreciated x
