Hi Big Aid

You will hardly have enough room on the Small Claims court form. Just give a brief discription of your claim ie how much, interest, and on what grounds you are claiming. If it goes to small claims and they dispute you will be asked to submit all nesessary documentation 10 days before the hearing.

If I can help in any other way just yell.

i have been very busy for a few weeks and wasn't able to dedicate any time to the site and my own case, but all of that is over now and i am back, more determined than ever before.

 

got a letter this morning from mairead gourley, basically saying blah, blah, blah, p-ss off for another 4 weeks.

 

has anyone ever spoken to mairead and if so, what was the response.

i lodged my initital letter in June and have now had two of these letters looking for another 4 weeks. Not sure what to do, give them an opportunity to investigate or just launch straight in with an action?

well,

my return date has passed without dispute, but it has emerged yesterday afternoon that the civil processing office in belfast has got a backlog that means all of the mail received yesterday has not been inputted on the system. i can apply for a default decree but they have advised me to wait until late monday afternoon.

 

 

maybe????

the things you have listed arent reclaimable BigAid. they are seen as charges for a service and therefore are not a penalty. stick to returned dd fees, returned cheque fees and the first trusts favourite the good old referal fees, they really love sticking them on.

Hi Ive just sent my Data Protection Act letter today.

Have sent it my local branch via recorded delivery, is this okay or should I have sent it to the address registered with the commissioner?

So really want to get back at the robbin gits.Have told everyone in office about it and they are going to claim as well!!!!

Which really says something if ex bank staff (me) want to get their hands on the thieving b********ds!!!!!!!

Yes, you should have sent it to the Data Controller of the bank as registered with the Information Commissioner.

 

No matter, just cancel the first cheque, then send another SAR +£10 cheque to the Data Controller at their official address.

 

You dont want to give them any wriggle room, so may as well play the game correctly.

I know of at least 2 people who have been successful against First Trust, they settled out of court but the people had to sign confidentiality agreements my claim was due to be heard on the 8th of the month but was adjourned as the Judge wants to wait for report from OFT at end of March. Hopefully when the claims in the merchantile court are heard in February a precedent will be set and they will start to settle.

Data protection act letter sent ,received partial info with 2 days to spare.

 

Preliminary Approach for refund sent 19/08/06 standard delaying letter received 25/08/06

 

Posted Letter before action 06/09/06

 

NI Small Claims Online 22/09/06 filed claim for£1977 with interest and charges comes to around £2800.

Return Date 26/10/06

 

Court Date Adjourned at direction of Judge awaiting OFT/Competition Commision report due March

I personally witnessed one of those with my own eyes-a very nice lady who is a member here.She not only got her charges back-she claimed for EVERYTHING they had taken from her account,and got the lot refunded!! She could not believe her luck....

hi i got all my statements and have added up charges - comes to about £400. I have included anything that says "Fees dec '04-Feb '05" (for example) i presume these were the fees accumultaed for a quarter for going overdrawn and are claimable??? (this was a normal current account)

 

Also i take it my £8 monthly fee for packaged account that i eventually changed to is not claimable?

Got a letter from ft today saying the usual rubbish...these charges are not penalty/default charges blah blah blah.

had asked for

- quarterly tranaction charges incurred even if i was over for 1 day and a small amount

- mortgage redemption quote charges

- referral charges

- mortgage sealing fee (£179.04 in april 2005, mortgage held for only 2-3 years

- late payment fee on credit card.

they have said they do not feel they have a case to answer but are willing to offer me 50% i.e £47 of the fees they are willing to consider (referral charges & late payment fee). my request was for about £400 !!!!

 

dont think i should take this measly offer.

any advice/suggestions anyone?
