i have been posting on various threads until now but i will give a brief rundown of my progress so far

 

10th march- DPA request letter sent to local branch

 

18th april - local branch reply said basically you got your statements and charges were as per price list

 

20th april -i sent letter saying clock is ticking

 

26th april - received request for £10 saying only limited info available

 

28th april - sent £10 and letter saying clock is still ticking and full info or statements needed

 

9th may - received info they sent under DPA. totally inadaquate, lots of letters and handwritten notes but only a printout of the last few months similar to what can be got from online banking.

 

11th may - phoned data protection officer and was told that due to tha "Durant" case i was not antitled to info held on microfiche as it was not a relevant filfig system.

 

11th may - phoned info commisioner and they said almost the exact same thing. except that i maybe should have got more than a printout of the last 2 months because there should be more than this on their computer system.

 

15th may - i sent a letter threatening info commissioner and county court for non disclosure

 

18th may - letter received today saying that their position remains the same

These guys sound like a right bunch of tossers!!

 

Why not just add up the amount of charges for the number of months they gave you,and multiply by the relevant number to get a total for 72 months,slap in a claim for that and let them prove otherwise!!

spoke yesterday to info commissioner

they said that they are fairly powerless even if they find that i haven't been given the correct info. even then it would still take a court judgement to force them into giving out all of the correct information.

 

how do i start a county court case to force the bank into giving me all of the details that they have.

 

is there a thread or link

If you check in the library i think there is some info on how to claim using an estimate, i think in previous cases if you have overestimated the charges the banks don't be too long in telling you and providing the list of charges. Good Luck!!

if it were me,I would slap in a county court action to force disclosure(I believe the details are in the FAQ'S-or post in the general forum about how to go about it and some of the mods may be able to point the way you should go,and then estimate a figure for charges(keeping it under the small claims limit) and hit them with it.They will then most probably and miraculously find a way to provide the information you originally asked for.

 

I am looking at this scenario with the Northern-tomorrow week is the DAP deadline for them,and I already have a parachute account ready should things turn nasty!!

good luck with your claim. just looked on AIB who own first trust in the south

they charge just €6.35 for returned items though they do charge fee for running

account. still a lot cheaper than £30.00 though. wonder how £30.00 is fair under

law yet only €6.35 in the south. eu law on unfair terms applies there too as it does

in uk under UTCCR.

Data Protection Act sent to Nationwide 19/05/06.

Statements received 24/06/06 - Charged £1,954.50 :eek:

Prelim letter sent to Charles Bacon 27/06/06 :)

Cannot refund letter from Sarah Watson 07/07/06 :rolleyes:

L.B.A. sent to Charles Bacon 18/07/2006 ;)

Claim deemed filed 30/08/2006 8)

I don't know if you have received the info yet, but my statements came in the mail this week with no further requests to the first trust, i hope you get the info soon and hopefully they are now changing there procedure and providing the info as requested.

at last my good friends at first trust have come to their senses and sent me copy statements for the 6 years, saving us a day in court.

a quick run through them leads me to a figure of somewhere around £1800.

 

no work for 5 days now so i am going through them very carefully

 

thanks to everyone for your support getting over this first hurdle

just received an acknowledgement stating their investigating procedure

they say that it could be 4-8 weeks for a full investigation

 

do i write to them explaining that we are moving forward on my timetable

My guess is that you will get your reply next week. They were very quick to respond to me. But you know to stick to your timetable of 14 days from the date they would have got the letter.

Hi guys...

 

Been watching this thread with great interest.

 

I sent Two DPA requests (and two Cheques) last week, and having a legal qualification I inserted my letters after my name. (should be interesting to see if I get treated any different then the rest). The two cheques have already been cashed, so I await in anticipation...

the letters after your name may force them into a position where they know that no crap will be accepted. have you any legal knowledge or experience of this type of case

Did speak to a bank official who works in Ann Street in an unofficial capacity at a function the other night.... they are not happy campers at the minute
