Hi Dora,

 

Please could I ask a very quick question on your thread as I want to trot down to court in about half an hour, and I know you have people 'live' here. I'll start a thread on this but it's a bit complicated so haven't done so yet.

 

I am defending a case - private, nothing to do with banks, etc. The Order said that the standard disclosure lists must be exchanged by last Friday, 28th August. I sent mine by recorded delivery last Tuesday . I had also asked the Claimant for documents which will totally contradict the claims made in their AQ.

 

I have not had the SD form or a response to my request for their documents, and document inspection should be complied with by this Friday.

 

I have done my letter to the court explaining all this, but what can I ask the judge to do? Would it be normal to ask for a strike out at this stage? I doubt if I would get it, and they'd probably be given more time, but should I ask?

 

Grateful for any advice.

Hi andy all docs are copied and ready to send tomorrow i have also put a couple in i think they might like to see would that be ok:-) i am surprised :eek:they have not requested them in the disclosures thanks for your help:)

I would only supply what they have requested TBH Dora.Unless they are shattering to to the Claimants Case if you could state what they are and why you feel they should have sight of??

Just sent my Other Doc,s off the address on the letter they

sent me didnt show up on the screen at the PO did you have the same

trouble , again we are sending at the same time same things we will

keep them busy:D

Hi Tonka if this is a new address to match their new letterhead (I think it was Hove) then I had the same problem with some stuff that I posted

 

Hmmm, so are they now going to plead they didnt received documents because of the change of address ? It is up to them to inform the courts of this I would have thought.

Hi andy its me again lol:) well they have received and signed for the docs i have sent them, still now sign off theres i have asked for, i have to submit WS on the 21st SJ on the 29th thanks:)
