Well Dora you have done yours and followed procedure.If the Claimnts dont compy by then there is very little for you to inspect im afraid.As said if Monday comes and goes and still no word then i advocate you apply by application (N244) to strike out the Claimants case.Now that is procedure;)

Hi andy i have received letter saying they have received in receipt of my docs sent by standard closure and pursuant to the order of the district judge xxxxx we note however that i have failed to properly comply with the terms of the order in that have failed to enclose copies of the docs of the docs listed they have enclosed their clients list of docs, we have have not enclosed copys docs and will only forward these once you have confirmed the date upon which you intend to forward your copy docs:confused:they have enclosed there n265

Ok Dora so no suprises there i would advocate you email them and request No 6 memoline Data and No 18 Second WS and anything else you think you have not seen.

Point 2 of the last box is interesting "original applicaton form/Agreement which has been destroyed":D

Thanks andy just off to post letter now special, i now it cost more but least i now they would have received it:) it being a bank holiday aswell thanks once again for your help i am sure i will be back for some more help lol:|

extra doc,s to them , maybe Andy is having a few days off

im sending mine tomorrow as I only have seven days before

they go for an order we need to send anything which we shall

rely on in court , they want my D/N i would like to say why you

already have one you poached of my thread:D which was produced

in court from this Website:eek:

 

We will be ok Dora lots of Caggers with us :)

Hi Dora,

 

Please could I ask a very quick question on your thread as I want to trot down to court in about half an hour, and I know you have people 'live' here. I'll start a thread on this but it's a bit complicated so haven't done so yet.

 

I am defending a case - private, nothing to do with banks, etc. The Order said that the standard disclosure lists must be exchanged by last Friday, 28th August. I sent mine by recorded delivery last Tuesday . I had also asked the Claimant for documents which will totally contradict the claims made in their AQ.

 

I have not had the SD form or a response to my request for their documents, and document inspection should be complied with by this Friday.

 

I have done my letter to the court explaining all this, but what can I ask the judge to do? Would it be normal to ask for a strike out at this stage? I doubt if I would get it, and they'd probably be given more time, but should I ask?

 

Grateful for any advice.
