And may I say a very BIG THANK YOU to every one who set up this site, without you all I could not have done this,I and yes Bookworm Voucher on Its way. The Banks must be terrified now. When I first Join in Feb the members list was only a few pages long, But Look at it now!!! Keep going everyone, Its scary, but you can do it.

 

And Snoopy71 I sent DPA/Preliminary request on 20.02.2006

01.03.2006 letter before action

15.03.2006 filed moneyclaim

22.03.2006 Acknowledged intend to defend

04.04.2006 paid up, but as yet not letter to acknowledgment.

 

Jonni2bad, Yes cant wait to get letter to see what their reply is , I am woundering if they will close the account.

Just to keep you all up to date received letter today from Halifax stating:-

 

Without Prejudice

 

Bla Bla Bla

 

I have returned the form of Acknowledgement of Service to the Northampton County Court indicating that Halifax intend to defend your claim. However, on a purley commercial basis, it will cost Halifax money to defend your claim in terms of the legal costs that will be incurred. It is unlik;y that tha Halifax will be able to recover these costs (even if the bank wins)because your claim will probably be allowcated to the small claims track. in which costs are not generally awarded.

 

For this reason, but without admission of liability, Halifax is willing to reimburse the full amount claimed.

 

Bla Bla Bla

 

Ultimateley it is your responsibility to manage your account. If you incure any future charges you will receive 30 days notice and your account will be closed. Bla Bla Bla

 

 

Can anyone tell me, what the without prejudice means at the top

It means you wouldn't be able to use the letter in court - essentially.

That sounds like victimisation - they send this to you, presumably as a condition of having an account. If this 'clause' is one of those conditions, then it should be made known to all customers, not just the 'troublemakers...'

Ready to go to Court with Halifax Credit Card, But their address is Pitreavie Business Park, Dunfirmline, Fife. I live in England, do I go through the Scottish Courts. If so can any one point me in the correct direction, for help. Had a look through FAQ but still a bit unsure

Halifax's head office, and the one you should send your summons to is in Halifax, not Dunfermline. The Dunfermline facility is just an enormous call centre (about 2 minutes down the road from me). Use the moneyclaim website and do it all online. Have you first written to them to demand your money back?
