Jonny thanks for that although im not sure if it applies because although many of the agreements ive had with the co-op bank are un-enforceable the current one is.

 

The reason the account is in dispute is because i have an ongoing PPI claim that is in the hands of the FOS and as my claim is for some £20,700 and the current Loan is £6,500 they can swing.

Today i recieved in a pretty bright yellow envelope with scruffy writing a card from the co-op bank saying that someone from POWER 2 CONTACT LOL HEHE will visit my home address

 

Unbelieveable

 

Im livid time to give them a call

Sorry PF - I didn't mean to leave that bit in about the unenforceable agreement - that was part of the original letter .... but there are many other reasons for an account being 'In Dispute ' and I thought maybe your situation was one of them... therefore these criteria would still apply... :-)

Ok I've just had a heated chat with someone from the collections department at the Co-op bank and i cant believe that the right arm does not talk to the left as he says that they have no record of any of my letters sent to them when i sent them to the same post code.

 

All he went over and over was the fact my current account is £180 over the agreed overdraft and my answer was always well if you take the £380 in unfair charges of that my balance would be within my agreed overdraft lol

 

I also stated the account is in dispute because of this and it states on your website the following:

 

As previously agreed with the FSA and the Financial Ombudsman Service, customer complaints relating to unarranged overdraft charges will currently remain on hold. The Banks and the building society will continue to ask County and Sheriff Courts to keep cases relating to unarranged overdraft charges on hold until the test case process is concluded.

 

Having a cup of tea now to calm my nerves he rang at the right time as i was livid anyway due to a pretty yellow envelope arriving though the door this morning with a calling card inside.

 

The war has started and it aint gona finish until ive won any other Creditors wana ring while im in the mood lol.

Update

 

Hiya All,

 

Still getting letters another one arrived though the post this morning, so i decided to telephone the FOS they said they cannot get involved in cases of harassment that they are investigating but because of my medical condition they will fast track my ppi complaint.

 

They also advised that i call the OFT regarding harassment.

 

No within an hours i got an email from the FOS saying my complaint has now been past to an adjudicator.:)

 

I phoned the OFT and got straight though and outlined my complaint i have going with the FOS and that they advise that i contact you regarding the harassment.

 

Very nice polite chap he was he said because of the fact i have a medical condition inc hypertension and that i had been to see my GP this morning who put me on Ramipril 2.5 mg to bring my blood pressure down he will investigate this complaint with urgency and pass it on also to my local trading standards agency also.

 

Things are now looking up.

Great bit of news. You are on your way. Adjudicators are pretty helpful just got to make sure they have the full story. Medical conditions are something these banks do not take into consideration. To them it is all electronic.

 

DD not paid......charge

Unpaid cheque..........charge

Unauthorised overdraft..............Charge.

 

How about this for an eye opener.

 

My dad 86 blind and partially deaf decided to give cash gifts for Christmas.

Now he has two accounts with a bank a savings account with cash in and a current account with a little cash in to cover direct debits like coucil tax.

 

So my dad writes cheques on his current account to the family and yes insufficiant funds in that account to cover the cheques but he was aware he had funds in the bank to pay the cash.

 

So the bank do the following and I understand it is all electronic and they will look at the particular account and not compare with other accounts held by the same person.

 

Account 1 with limited funds

the cheque for £500.00 an unathorised overdraft is put into force letter sent out

Cost of letter £35.00

Cost of unauthorised overdraft £28.00

 

Account 1 with limited funds Cheque for £1,000 cheque is referred to drawer cost of letter £35.00

so for a genuine mistake for a blind deaf man aged 86 on pension the cost was going to be £98.00 when he had funds in account 2 savings which easily covered this.

 

I saw the bank staff and the charges were withdrawn cash transferred to cover the cheques and it was sorted withinh 30 mins thanks to understanding staff.

 

Point is how much of this is going on where people are not standing up or getting help.

 

The electronic system does not work as can be seen from the forums on CAG

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

I also have hypertension. Its amazing how much these things affect us. I have had another eye bleed this weekend. Try to let the adjudicator deal with it now and take a breather. Its not worth your life.

I also went to see my doctor who gave me some ramipril 2.5 mg tabs which i must say are good i feel a lot more relaxed now must of been the high blood pressure.

 

Im glad i got those as im due in court on the 15th of this month re: MBNA

do not worry though i have that in order as they have no original agreement and the default they served is un-enforceable plus the judge turned down Optimas n244 for summery judgement.

 

The OFT are investigating my complaint of harrassment and also letting my local trading standards know.

 

As for my Complaint regarding PPI that is with the FOS they are now fast tracking it due to my medical history thanks for that tip.

Yes i will be glad to see the back of this claim its been dragging on now since July 08 anyway i have told my wife if we are successful i will treat her to a weekend away somewhere before i start my next battle with Halifax.

UPDATE

 

Hiya All

 

I thought it was to good to be true lol, had another threat letter today and they have decided to start emailing me and the wife not sure where they got the email addresses from because i did not give them out to the bank ?

 

I also sent on friday all the letters i have sent to the bank because they said they have not recieved any mail from me ( load of bull) i sent them via special delivery cost me £5.05:mad: but worth it i think they signed for it today so at least i know they got there.

 

Still got a call this evening though will they not give up. I think i will now reply to there email then print it off.

This was disgraceful aa.. especially as the banks are not above helping themselves to your cash to offset debt repayments when it suits them. I am pleased you got it sorted out.

 

Pompey, Do you have internet banking? this is where MBNA got my email address from. As a rule I would not have signed up to internet banking for a credit card, however I wanted information regarding a points system MBNA had offered and wanted to swap them for a Tesco Voucher. Even though I never used their system again, they still of course had my email address. I have since marked their email address as SPAM so if they are still sending me emails, I dont get them:D

Hiya All,

 

Right after giving it a few hours thought, ive decided to blow a big hole in the co-op banks butt and expose them for a change to the sunday times in response to there constant harassment and perhaps get PPI a bit more expossure.

 

They asking for people with medical conditions so i think i qualify there.
