      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi fellow members:D

 

Last year there was a Welsh meet planned for December. Sadly, due to the organizers pulling out (for reasons only known to them) and some members not able to make it, it didn't happen. It was suggested by another member that I could try and organize one for this year (I thank her for her faith in me lol) After months of debating I have finally plucked up the courage to post this thread. I would love to meet fellow members but as the other meets are a bit far to travel I hope very much there will be a good response and we can have a get together here in Wales:)

 

I live near Cardiff but up for suggestions for date/venue etc, don't want to clash with the other meets. Here's hoping I get some replies lol.:p

Sounds like a great idea! I'm up for it....Cardiff is ok for me, although I live in Westest Wales! It would be interesting to meet other claimants face to face...although I haven't yet got any money back from RBOS, it would be good to think they funded the trip!:lol:

I'd like to meet up with other CAGers in Wales too. I'm based in mid Wales - I could travel to Cardiff (everywhere's a long way from here!) The devil in me wants to suggest the Royal Welsh Showground, in July!!!

Hi Boo, Gizmo and Manic *waves* yay, the more the merrier!:D I have to say it won't be on the 1st July then (sorry Cillit, would've liked to meet you) cos it clashes with the picnic, plus it's a Sunday and public transport would be limited.

Do any of you have any preference to where we meet? I am not a regular pubber/clubber so I have very limited knowledge on that scene, but I'd be quite happy wherever we go:)

Hi Varangian and Claire :D welcome aboard! Brill, we are into double figures. I am off on hols on Fri, so as soon as I get back (well, once I've watched the LOST finale!) I'll do some research and word of mouth, see if I can come up with a few suggestions. We could then maybe vote for a venue and date, how does that sound?

 

Does anyone else need a place to stay, or can provide, and are there any dates out of the question for anyone?

1 July is a Sunday, so I imagine it would have to be a daytime event for most were it on that day. Be aware that Speedway comes to Cardiff that weekend.

Hi peeps, yeh I'd already said that it couldn't be July 1st, due to other CAG meets and it being a Sunday. I don't know if any welsh members are going to the other meets, I can't cos it's too far to travel:-(

 

I am currently looking into dates and venues....how does 6th or 7th July sound? or 13th or 14th? both are weekends. If I can get a general idea on the best dates to suit most of us, then I will get on with setting a firm date. It will def be Cardiff I would imagine. Also if anyone needs somewhere to crash I could possibly put them up.
