  1. Hi Smutley, I am totally gutted too, there is just no justice to be had in Cardiff. As you have asked I did send in my N244 and ticked the 'hearing' box, I also included my fee and so did things the 'right' way. What does 'on notice' mean? How are Lloyds dropping their penalty charges, I thought they were just changing what they charged and calling it something else? Clare
  2. Hi all, Today I received my General Form of Judgement or Order regarding my application to have my stay listed. It states the following: Before District Judge Hendicott sitting at Cardiff County Court: Upon reading the claimants submissions objecting to the proposed order of stay it is ordered that: 1. The submissions be treated as an application to remove the stay in the order of the 8th August 2007. 2. The application is refused. 3. As this application has been refused without a hearing, either party may apply for the application to be reconsidered at an oral hearing. Any such application shall be on notice, and it is reserved to HHJ Hickinbottom or DJ Hendicott unless expressly released by either. Dated 03 september 2007 How are we going to get justice?????
  3. I have just received the following email from Nick Ramsey, Assembly Minister and am quite pleased with his response. At least someone is on our side! I am writing on behalf of Nick Ramsay AM to thank you for your recent e-mail regarding the arrangement between the OFT, FSA and UK retail banking industry to freeze out further overcharging complaints whilst a test case is being brought; yet continue to allow the banks to carry on levying penalty charges on customers. I have discussed this matter with Nick and he was extremely sympathetic to your case having himself been victim to unforeseen penalty charges in the past. Nick was extremely sorry to hear that you have so far been left hundreds of pounds out of pocket through the process of making a claim. Nick has therefore written to the FSA highlighting the concerns outlined in your letter. As you state in your e-mail this issue has affected many thousands of people. There is a review currently in process and I hope that Nick's letter will serve help your cause in some way. It may also be worth contacting your local MP David Davies to ask for his support. Hi Smutley, I'm going to send you what I have written so far. -and- BARCLAYS BANK PLC Defendant I hereby include this information to support my application to have the stay on my claim against Barclays Bank Plc lifted. This information shows that Barclays Bank Plc were intending to settle my claim out of Court but due to Mr Quinn not replying to either my phone calls or emails, I am now in the position of having my claim stayed pending the ultimate determination of the Commercial Court litigation. On the 22nd May 2007 I spoke with Paul Quinn from Barclays litigation team, who informed me that he would be settling my claim before it got to court. Paul Quinn informed me that I should contact him again 3-4 weeks prior to the Court date of the 14th August 2007. I attempted to contact Paul Quinn and his colleague Krysta Campbell by phone on the 17th July. I left messages on both Paul Quinn’s and Krysta Campbell’s answer phones but received no reply. I emailed Paul Quinn on the 25th July and 30th July and received no reply. I emailed Dino Papaevripides on the 30th July and received an immediate reply. The final paragraph of Barclay’s letter dated the 7th August 2007, regarding this claim, states that “As a general matter, we will ensure that your claim will not be adversely affected by the stay of your court proceedings.” (a copy of this letter is attached.) I hope you agree. I have read that some cases are still being heard in court despite the OFT ruling. As part of the application to lift the stay, it would be really useful to include details of courts where the Judge has decided to carry on with the case.
