Just compiled my SAR for period right back to 1993 when the account was opened.

 

Sent to London E14 recorded deliv.

 

will be looking for advice on updated templates etc to handle this as it is new ground.

Will also be following every move dar3n intend to follow your lead once present claim is in the bag, (6yrs) which should be in next couple of weeks or so, then it's back to approx 1994 ish. so be following with interest!!!

I will be following you at a safe distance anyway, by the time final settlement comes my way (approx 2-3 weeks with any luck), you will be well down the line! and i'll be just starting, so no worries dar3n. anyway i know you won't mess up!!!!!

hello there dar3n , just a quick question .

did you send the standard SAR and just amended it to suit , or is there another SAR template specially suited for pre 6 year claims.

i'm only asking cos having won the last one i would love to see how much they have taken before that .

I used the standard one but amended it stating I wanted the records going back to the date the accounts were opened, stating it had been brought to my attention that Barclays do infact hold this information and therefore I am entitled to view it under the DPA 1998.

I have two court cases ongoing with Barclays (One for Non-compliance of DPA and one for Charges back to 1998 !)

 

I will subscribe to this as I will also be submitting a claim after these are cleared for the period of 1991 to 1998 !!!!

Go for it dar3n, I'll be keeping an eye on this thread as well and once my current claim for 6 yrs is complete, I'll be going for it as well.

 

Come to think of it, there is nothing stopping me sending the SAR now is there?

23/02/07 Request for payment sent (hand delivered to my local branch)

08/03/07 Standard Letter from Barlclays saying they are looking in to my complaint received

13/03/07 Letter before action sent (hand delivered to my local branch)

27/03/07 Partial offer of £1255 received

29/03/07 MCOL submitted

Ouch ! Now that certainly is chancing it !!! haha Should be very interesting....you can imagine their litigation department opening that Notice of Issue and quickly advising of a profits warning for next year's accounts !!!! lol

Yes, I'd like to think that the legal foundation remained unchanged but I suspect the sheer amount of interest would be iffy

 

I suspect the regular 8% will do just nicely

 

Be nice to fill the spreadsheet in though and see

 

Who knows, if they're difficult and sir is feeling bolder by then ...

8%, yeh i agree especially on a second claim they would be more likely to settle quicker [lol yeh] if just claiming the std int and not CI.

 

I will stick to the 8%,

as far as im concerned didnt have it yesterday so its a bonus what ever amount

Is it really feasible that claiming back from Barclays 10/15/or even 20 years a reality?For us the consumer it would be brilliant ..however for the banks it would be devastating.Im not defending them im being realistic ,after all im sticking my SAR as soon as ive got some head way with this claim at present.I just think the banks are really going to fight the claims for 10/15 years etc.Thats my opinion anyway.I hope im wrong as going back to 1987 when my account opened would be a truely large stash of cash.!

yes hippo but you would only be making a second claim because they never complied with the SAR .

it clearly states , and i quote,

''Please supply me with a complete list of transactions and charges relating to my banking history with your organisation''.

yet they are only supplying six years worth so they are in the wrong .

hehe.

second SAR going off pretty soon i think.;)

have you thought about contractual intrest. My first claim is for an account dating back just 3 years or so, but have a previous account dating back to 89. Going for the easy 8% on the first one and when its out of the way am thinking of going the whole hog with contractual intrest on the second one.

To be honest mate I did think about it and yeh it would be nice to have the extra few pennys, but im expected a bumpy ride as it is claiming again so im sticking to the 8%,

Anything is a bonus from here on in.

Right here is the first wave of doubt,

 

I have read on here, a thread where the case actually went to court and the judge [Dickinson] booted it out cos ALL the charges claimed were pre 6 yrs.

 

This judge would have been the same one I would have got in my claim #1 so the chances are he will be again...

 

Im wondering if he is of the 'old boy' school and cant see past his glasses and will throw mine out too.

Am i right in saying that there has been successful claims (pre 6yr) in the past few months??? if so does that then mean it comes down to the who is sitting in the chair at the time!!
