Friend unknown PCN - now Jacobs removal letter

A friend just called me panicking, saying she got a "through the door / delivered by hand" letter from Jacobs DCA, it was unmarked envelope through the door - Obviously in red ink to really scare her, to do with a parking charge notice, for some reason it was unpaid. 

 

It says balance due £400+ pound (actual amount hidden for privacy).

And in big red box 'removal imminent. 

 

He even text her to say "unfortunately a warrant has now been issued and the  vehicle will now be removed, regards, Mr ****." 

 

Are we to assume that as usual all DCA are using fear tactics to scare people into paying them a fee that they have no right to ask for... ?

Can a DCA ever get power to remove a car? The car is worth under £1000.

 

Any help is welcomed.

Yes Jacobs as enforcement agents could have the car removed and sold.  And with the additional fees involved for the removal and sale, there would be no money left after the sale.

 

Suggest it is paid and then pursue the matter afterwards, if there is reason to dispute the PCN.

It's not a DCA, it's a court bailiff!!

Big diff.

 

So she knows nothing about a council PCN, has she moved recently, if she has, then she needs to fill out a couple of forms to tell the Council TEC this .

 

They could clap the car if it's hers (registered keeper) ,yes and then remove it from the road if not on private drive

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

So Jacobs have a permanent signed court warrant that lets them do anything they want?

 

Also waiting on news about correspondence etc. 

 

What if car is worth under £1000/900 and she needs it for work?

Not sure what you mean by permanent warrant?

 

It's an unpaid council PCN, which although decriminalised many years ago, doesn't mean everything can be ignored like a private speculative invoice for parking 

 

Once we know the answer to our questions..like has she moved in recent times or just ignored everything to date, we can move her on 

 

But until then, we are , like you, just guessing at things 

 

If she knew nothing nor received the PCN then with the correct forms, everything will stop.

 It will need to be done ASAP, as for dropping off the letter they might well have added £235 to the debt, she should have had an initial letter through the post from jacobs giving her time tio come to a payment arrangement, however if  the vehicle is there and available Jacobs will clamp it, they also have form for clamping third party vehicles parked outside a debtor's address.

@mrk123  -  if this is a local authority PCN your friend should have received several different items of correspondence which, if not reponded to, can lead to a court order for seizure of goods. 

 

Some people get the correspondence but stick their heads in the sand and think they can ignore it - they shouldn't. 

 

Other people don't get the correspondence because they've changed address, or the address on their car's V5C is wrong, or it's a hire car.  (Or some people change address and update their driving licence details but forget to update the V5C.  They think they are linked, but they aren't - you have to update both).

 

Didn't your friend get a PCN on their windscreen?  Or was it a moving traffic offence?
