Unintentionally stalked my 2 Instagram crushes

I’ve subconsciously and unintentionally stalked my 2 Instagram crushes and unwittingly tracked their galleries. One of them complained to Police and I have to attend court charged with stalking. I do admit my careless actions have made the accuser feel unsafe on two occasions. It was never my intention to act maliciously, victimise or cause distress to anyone.

 

I posted on a mental health forum asking advice on the issues I had with 2 the girls. I’ve sent this link to the accuser to try resolve our issues. 99% of the thread was talking about the 2nd girl though the accuser thinks it was about her. During Police interview, I told them it’s not the same girl but don’t think they believe me.

 

The 2nd girl has not complained to Police although last time we chatted, she said she’s took screenshots of everything and blocked me. Unlike the accuser, the 2nd girl has not given me a final warning not to look at her profile and never said anything about stalking or being unsafe.

 

The Police do not know who this 2nd girl is and are more concerned with the accuser. In regards to the 2nd girl. Do you think I’ve broken the law? Can I be charged without a complaint?

The two girls on Instagram.  Public or private accounts.

 

If they were private and you asked to follow, can't they just block you ?

 

Please explain how your behaviours could be seen as stalking.

 

Suggest you seek legal advice where you can discuss all of your actions.  This site is a consumer forum and not really appropriate for criminal matters.

Hi

 

I don't think posting on a Mental Health Forum asking for advice will assist you but you really need to make an appointment with your own GP and speak this over with them as they can get or refer you for any other help you may need on the NHS.

 

As the Police are now involved in this ,matter due to one of the girls making a complaint of Stalking to the Police and you are to attend Court charged with Stalking the Police will have evidence of this for the matter to be proceeding to Court so you really need to get proper Legal Advice on this matter.

The accuser’s account is public and the 2nd girl’s account is private.

 

In a 16 month period, the accuser caught me looking at her account twice after being blocked. Once my name showed up on the story list and 2nd time, I wrote a comment on her gallery through another account.

 

On May 2022, I sent a message to apologies and to say there’s been a misunderstanding but then I made unfounded accusations due to paranoia. This is when the Police were contacted. 

 

I was kind of Instagram pals with the 2nd girl as we chatted many times on her gallery and through private messages. She accidentally found out about the forum post and sent message to say sorry and said some of it was true but denied the accusations made on the forum. This is when she made me realise, I had been tracking her account.

When I first started Instagram 3 years ago, I had social interaction difficulties. I was receiving attention from girls and I couldn’t differentiate if they were romantically interested, leading me on, boosting their Instagram engagement or after platonic friendship. I persistently made errors when mixing with girls, though I was learning from my mistakes. Last year were the best dating experiences I’ve had in my life which resulted in meeting a girlfriend.

You need to obtain legal representation locally, as you do not want to end up with a criminal conviction, for what appears to have been delusionary behaviours, rather than stalking.

 

If you end up with a criminal conviction, this will cause you difficulties with many things over a period of time, including possibly your employment.

 

Whenever I view instagram, I see many people with accounts, who just appear to be attention seekers, rather than just recording pictures of exciting activities they have experienced, which they want to share with their friends.

It’s made me feel I’m 100% in the wrong and it’s not true. Both these girls appear to have mental health issues. The accuser is very depressed and joked about being in a lockdown when all the restrictions were lifted. Both of them have played games with me on Instagram and I have screenshots proving this.

 

Some of the presumptions the accuser has made about me are completely wrong. The paranoia and trust issues she is experiencing is probably caused by traumatic events and toxic relationships that's happened in her life. Someone made a great point in my mental health forum thread and said crazy people playing mind games with other crazy people.

Is it possible that everyone is playing mind games? You did say higher up the thread that you yourself made unfounded accusations through paranoia.

 

As Uncle Bulgaria said, I don't see how much we can help on this forum when there's a court case involved. Local legal advice from a criminal solicitor is likely to be the way forward.

(1) Have you been given a date when your case will be heard by the magistrates court?

 

(2) Have you seen a solicitor yet? If not you really need to do so as soon as possible. Stalking is potentially a serious offence for which people can be sent to prison. You need professional legal advice from a criminal law solicitor.

The accusations were made during a minor relapse in my mental health. I have a court date and a solicitor though so far only had 1 phone call. The solicitor says he has to wait to see the evidence in court. I just have 1 more question and thanks for the help.

 

My girlfriend and I have been discussing both these girls on whatsapp before being charged. The police have my phone as evidence. Our chat could maybe prove I was oblivious to the stalking. My girlfriend could write a court statement saying that she believes the stalking has been unintentionally and I might have autism.

 

I’m aware that accidental is not a defence. If it was delusionary behaviour rather than stalking. What would this achieve? Could I plead not guilty to stalking but guilty to a lesser offense?

You have a solicitor @FGW351, this is a question you must ask them because (a) they are a solicitor and none of us here are legally qualified and (b) your solicitor has access to all the facts that are available and we don't.

 

Given how serious your offence could be I think a single phone call with a solicitor isn't enough. In your positon I would arrange to go and see them and ask them the questions you have asked here.

 

Have you qualified for Legal Aid?

I've been seeking help for the last 25 years for a psychotic illness and I'm starting the process to be diagnosed the autism.

 

I've had some mild delusions and hallucinations though I think my biggest issue was not reading people correctly and misreading signals.

 

The last couple years I’ve been on a steep learning curve in terms of socialising with people.

 

What happened with those 2 girls will not be repeated and in the last month I’ve learned so much about stalking and harassment.

Yes, I have qualified for legal aid. However, the solicitor has given me the impression there’s not much he can do until he sees the court evidence. All the police have told him is that I have been charged with a section 39. I’ll make an appointment to see him.

I don't think anyone contributing to this site can add to what has been said already.

 

Because you have a live ongoing criminal case, I am thinking the thread should be closed for your protection. Nothing you have had said so far is going to hurt you, but I don't think your Solicitor would be happy that you are discussing these matters online.

 

Suggest that you stop posting to online sites and concentrate instead on 1) your health, which you need to speak to your Doctors about and 2) your legal position, which you need to discuss with your Solicitors.
