i'd do nothing of the sort.

 

let them goto court with this

 

I doubt if they would wish their actions

like knowing levying PENALTY charges

on accounts when the OP is on benefits

to be exposed in court.

 

not sure if you done the following

but this is what I would do...

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

as an example>

I am currently in financial difficulties and not able to meet my normal monthly repayments.

to show my goodwill, i am going to pay £5 for 6 mts.

 

i will update you in 6mts time or before, should my situation change.

could you please as a reciprocal goodwill guesture,

Should you fail to assist me during a period of financial difficulty, contrary to all the guidelines and codes

Thanks for that, will do that this week, as I just don't know why they think that it is fair, and the FOS thinks it fair, to let them get away with this.

Just to update on Nationwide CC, which I made an agreement for 6 months, to pay £1 a month, from March.

 

 

Just received a letter from a DCA, saying if I don't pay up,

they are going to take legal proceedings.

 

 

I have paid £20 a month, and never missed a payment within the arrangement.

 

 

They never sent me a letter of assignment to this DCA,

so they can't do anything can they????

Just respond with something along the lines of..

 

I am very concerned by the tone of your letter. I have entered into a repayment plan with BANK and no payments have been missed.

 

In view of the above, please advise on what basis you are intending to instigate legal proceedings ?

 

I look forward to your urgent response.

 

 

 

Can you let us know what DCA this is.?

 

It is likely they are simply acting as 3rd party collection Agents on behalf of Nationwide so no NoA would have been sent. However, you can send the attached letter to establish if there has been an account ownership change. Please note that the attachments are both the same letter.. however, some caggers are saying that the word doc doesn't download properly :)

 

If there has NOT been an assignment then the DCA are breaching OFT guidelines by saying they can start to litigate when in fact they do not have the right.

 

As you are in a repayment plan, then it is unlikely a court would look too kindly on them issuing a claim anyway :)

KPR collection, and I have just noticed that they say they will pass it on to a DCA, but it is a very nasty tone of wording. Yes I have an agreement for months...

Ok,

 

In that case they are "in house" agents. So there has been no assignment, so you can forget sending that letter (the attachment).

 

However you must send this one demanding to know on what basis they are going to litigate.

You need to make sure you keep copies of everything received and sent - however, IMHO, this is harassment, pure and simple.

Now I have received a phone call this morning from KPR, told them I wasn't in.

 

I still have the arrangement in place with Nationwide,

and am about to fill in an I/E form/

 

Things have gone up, like the house insurance because of the burglaries I have had, and my car insurance is through the roof.

 

I am in an arrangement, and have very little to buy everyday things.

 

Very very worried again,

 

cried my eyes out,

 

am I ever going to get out of this.

I have had another letter about my overdraft charges from nationwide, and they want my I/e again.

 

They say they cant refund charges on an active account, but it is only active, because I have been putting money in, and try and stop going over my overdraft limit.

 

Are they entitled to have my I/E, and I did send them the letter asking them to accept a payment of ..... a month,

and told them my situation, BCOBS, if they didn't accept the offer, I would only be paying them £1 a month for the rest of my life..... no pleasing them,

surely they can see that there is no salary going into my bank a/c......

total bowlarks. the charges are a penalty end of.

 

never heard that excuse before...its an active account, cant refund!! wow

 

under BCOBS they have treated you unfairly.

 

that's ok you've nailed your colours to the flagpole.

I&E sheets are none of their business

 

only a judge can demand those details.

Nationwide are now torturing me with phone calls, landline rings first and then my mobile, 4 times a day.

 

 

Even though I am in written communication with them, an automated phone call, a text message left.

 

 

How can I stop them?

Checked my credit report, and Nationwide have lowered my overdraft, without telling me,

which means I have even more charges than before, as it looks like I have spent over my limit, even though I haven't touched it.

 

I contacted Nationwide re my WTC going into the wrong bank, and now the Nationwide say they cannot look at my account as KPR are dealing with it.

 

HMRC are reclaiming the money back, to put in my new bank account.

 

Can HMRC get this back, as HMRC said to make sure the bank was not using WTC to pay off an overdraft, as it is a benefit.

KPR are NW's in house DCA

 

so they are lying.

 

hmrc are correct

 

the money is for YOU to live on

not for their bank charges

 

have you looked at a BCOBS complaint to NW?

and get the charges removed/refunded

I have tried that, and they just quote the case at court, that they are allowed to charge me. The case of McGuffin, or something. So I have no money, and they are wanting me to pay the overdraft off. I had to go out as the phone calls where driving me mad.

 

What was the email address, as I can't find it anywhere?
