I have told different situations to get advice on.

 

This is the absolute truth I am saying now.

 

Lets just see if my appeal gets accepted (which I doubt it will)

 

Oh and even if my criminal record stays I am rich anyway I don't even need to work I am just a perfectionist and this is driving me insane

Well my family is pretty wealthy, not me personally right now

 

Well, ask mummy / daddy / rich relative to pay, if they are already willing to subsidise you not working.

 

I predict it is going to be a tough fall for you if/when they stop insulating you from the realities of life.

 

You may be (personally) even less wealthy by the end of this process, too.

They don't know about this whole process and I don't mean it like that just that I can work with them or something if it all goes wrong.

 

Which isn't the same as "I am rich anyway I don't even need to work"

Tell the truth and it'll be easier "to stick to it".

I think CAG members should openly encourage iambilly to pursue this right through to the Supreme Court... he will anyway! Gives me something to read on Lexis :D

 

Don't forget the possibilities of Europe and the Human Rights aspects, a deep seam that appears yet to be mined by billy's razor-sharp legal insight.

 

Do I detect that it is not just the TfL prosecutor who has been laughing at iambilly?

I actually un-subscribed from the thread because I think it got ridiculous about 10 pages ago. It must be one of the most ludicrous ones ever on CAG and I can't believe we are still wasting our time with this OP.

 

If he is that 'well off', why avoid paying his fare in the first place??? AND before he comes back and says it was a 'mistake'... don't bother, because I for one don't believe you!

You brought it on yourself.

 

I suspect he has depleted any stores of empathy or desire to help from most, due to his actions and posts (not his initial fare dodging, but his actions and posts since).

 

He keeps saying "I know I look bad, but I'm not that bad" ... So stop making yourself look bad.

 

He believes "justice will prevail". I suspect it already has, and will do so further if he continues his ludicrous appeal.

Yes I have made many, many mistakes but I hope I can help myself

 

When were you planning on starting to help yourself, then?.

Going to a local solicitors today to try and get legal aid.

 

(Without legal aid his price will be £800 not including vat)

 

Knowing how the legal aid system works, you have more chance of winning the lottery based on your story. It would also be an injustice to the tax payer if you did manage to obtain it, using it to appeal against a conviction for abusing a travel scheme also funded by the tax payer.

That's quite cheap, £800. But, as the saying goes, you get what you pay for.

 

If I was the lawyer, "cash up front"!!!

 

Not too sure a solicitor can even (legally) help you. For starters, the solicitor would not have rights of audience in the Crown Court, with some exceptions, (solicitor advocates etc).

 

Can't a mod lock this thread and put it to bed?

 

I'll keep an eye on Lexis/Westlaw and report back if anything appears in the future.

Just got back from them.

 

Yeah it looks like I will be getting legal aid I think.

 

The solicitor guy won't be representing me, he is sending someone that can to meet me on the day.

 

The solicitor guy did say it was near impossible 99.99? to remove the criminal record.

 

However, it may get sent back to the magistrates court, where it may get reversed.

 

And please don't close the thread, I would like to let people know how I get on on Thursday.

Hi everyone.

 

Went to crown court today, my lawyer guy backed out the night before as my legal aid got rejected for some reason. So I had to represent myself.

 

Basically I was told couldn't appeal the conviction only sentence, spoke to the barrister of TFL and she was helpful told me I may be able to get the the my criminal record conditionally discharged if I am lucky.

 

Anyway after talking in court they decided that they would change nothing about my sentence.

 

The TFL side tried to make me pay £700 costs but the judge rejected that, so I didn't have to pay anything.

 

Anyway since my lawyer guy backed out the day before leaving me no time to get a replacement and me to stand for myself I will be trying to appeal this decision as I feel I was unable to get my point across due to crippling anxiety and nervousness.

 

Anyway for this reason I will be appealing my sentence again as I feel it was slightly unfair.

 

If that fails then I will be sending my appeal to the criminal case review commission to see if they think they can help.

 

I know I will get a lot of stick for this but it is my life and I should be able to appeal as much as I want to and I still genuinely believe that I have been misfortunate in these situation and deserve another chance.

I warned everybody he would keep going higher and higher! Self representation at Court of Appeal... least us, the taxpayer, isn't funding his jolly. You sure TfL aren't going to launch their own appeal, based on failure to award costs incurred?

What did the judge say? I assume he asked if you were sure about representing yourself....

 

"If you’re appealing against your conviction, you normally need new evidence or facts. For example, you may have a witness who was not at the original trial who could help support your case."

 

I have to remember this is an advice forum, so my primary advice - cut your losses now, move on in life. 22 pages of people telling you to get over it. TfL may not have gotten their costs this time, but they almost certainly will in the future, which will be well in excess of £1000.

 

Perhaps look at a Writ of venire de novo, (where there was an error in the plea of the defendant or doubt about what the true plea was). (If I've got the correct legal term).

I am not stopping until I have this conviction removed.

 

Where can you read the transcripts that will be quite interesting to see.

 

He was actually pretty understanding, he did not mention the representation issues.

 

The judges were too focused on the fine and seemed to not understand that I did not care about the fine, this was probably my fault, as I said I was very nervous and did not get my point across as well as I could.

 

My lawyer letting me down on that last day was pretty unacceptable and will be the main reason for my next appeal.

 

(just a question, do TFL get costs then since I did not have to pay them, how does that work?)

Quelle surprise .... legal aid bid rejected, no appeal against conviction entertained, and appeal against sentence not effective.

 

If your statements regarding your income are correct (even given your 'wealthy family'), then your legal aid bid being rejected wasn't on means grounds? so will thus have been on grounds of not having been found to be "in the interest of justice" (so, there is a clue there).

 

Your solicitor "backed out the day before" as you didn't get legal aid? I thought "money was no object" .... so yet again your story is inconsistent. However, it is consistent with you only seeking legal representation late, which is your own fault.

 

You "will be trying to appeal this decision as you feel you were unable to get your point across due to crippling anxiety and nervousness" - so maybe this wasn't as 'simple' as you had previously considered / asserted?. See, again, you didn't listen to advice .....

 

You have been consistently stupid AND ignorant.

You have already stated that you want to continue to appeal, and I believe that equates to a desire to continue to act stupidly and in ignorance.

 

You haven't been "misfortunate" ; you've got what you deserve (or, even, less censure than you deserve)

 

As for "The TFL side tried to make me pay £700 costs but the judge rejected that, so I didn't have to pay anything" - if your appeal against conviction wasn't even entertained, and your appeal against sentence wasn't granted ; do you really expect us to believe you didn't have to pay ANYTHING?.

On what grounds or by what means did you avoid the appeal fee?.
