Hi Billy, my younger brother is in the same predicament as you, got caught at Kings cross station, we're trying to find a way where he can avoid getting a criminal record, to be honest I'm looking to you for advice any chance you could forward give us a brief overview of what you have written in your letter?

Was he using a freedom pass? When is is court day?

After all, you came on here seeking help and other users of the site have given their time freely. Surely it's just a simple courtesy to put something back?

It think it depends how you read it, OC. My interpretation was that Billy meant he wouldn't put details of his website on here, which would be against site rules.

 

Of course I hope we hear what happens. I don't understand why someone wouldn't want to post up the result, both for all the guys here who've tried to help and for other people in trouble who arrive here. One of the most common questions is 'What it likely to happen' and that's when you find that lots of threads aren't taken to their natural conclusions.

 

Looking forward to hearing, Billy, however it goes.

Sorry everyone for the delay just got back from court.

 

It did not go well at all, the tfl prosecutor was smug and spent most of his time laughing at me.

 

The magistrates did not really respond to the letter I gave them.

 

I was ordered to pay £240 (which was fine) but now I have received a criminal record.

 

I will hopefully be appealing this case as I want to bring up the ticket inspectors unprofessionalism leading me to agree with everything which I did not do.

Difficult to say, although I know why you ask :wink: TfL rarely seem to settle out of court though. But then, unlike the mainline, their entire network is enclosed (barriered) and / or electronic (i.e., 'Oyster' smartcards), so they possibly assume that since it's that bit harder to travel 'accidentally', those that do it with the wrong or no ticket, must be doing it intentionally. Whereas TOC's (like EMT...) might just feel they have more rooom for manoeuver.

I would say that although the offences are effectively the same, and therefore the potential consequences, there is perhaps (but IN NO WAY to be relied on!!!) more causes and claims for for mitigation with TOC's. Although I'm not sure if that extends to altering train tickets :oops:

The OP had previously posted saying that he had been summonsed under S5.3 of the RRA 1889.

 

Further up the thread I'd posted a link to Merseyrail's webpage showing that a (conviction for a) bylaw offence showed only on an enhanced CRB, while the S5 RRA 1889 offences show on both the basic & the enhanced CRBs.

Can you stil work with this on ur record if u get this conviction and how long does it stay on ur record for? I.e. can you work in IT, finance or banking and how would it show as on a crb check under what title, name etc? sorry for all the questions
