Update

 

So, thought I'd give a bit of an update on my situation.

 

This morning I gave TS at East Ayrshire a call to make a complaint/report about the current situation regarding the most recent letter from Muck Hall - where they have totally ignored the fact I'm on benefits and have made an offer of £1/month and have demanded almost one week's benefit money every month until the debt is cleared.

 

I was thrown initially when the phone was answered by someone from 'Environmental Health Dept' - apparently the phone number is shared by both departments - would be useful if they said that on their website where I got the number from!! - anyway, after the initial surprise the lady put me through to one of her TS colleagues a Mr S.G. I informed him I was calling to make a complaint about MH and was surprised for the second time to be told that the no longer take complaints direct without first allowing MH to try and resolve them through contacting their compliance manager. SG gave me an email address for this compliance manager. Apparently they have this new agreement that I inform MH of the nature of my complaint and should have a reply from him in 5 working days or so and only if I don't achieve resolution can I then get back in touch with the man from East Ayrshire TS.

 

I did tell him that I had been advised to deal with them directly and not with MH but he reiterated that this is their new agreement with MH to give them time to resolve complaints - me thinks it's more a case of there have been so many people contacting them about MH that they are either snowed under and need some breathing space or they are fed up with not achieving resolution so are directing people back to MH or, God forbid and worst in my mind, they are hand in hand with MH in making people contact them again to be harrassed for ever increasing amounts that are totally unaffordable.

 

What should I do now?

I'd go along with Mr SG and copy him in on the email to MH, and remember 5 days is 5 days (including weekends), they don't give you any chance to reply to their 48 hour notices do they - play them at their own game and WIN.

 

I am convinced MH hasn't been closed down as it provides jobs for the area....

Mr SG sounds like he should be related to you with those initials!!

 

Unfortunately he didn't give me an email address so I cannot copy him in on any email I send MH. Do you really think they will take any notice of an email from me? After all, they ignored a letter posted to them and came up with figures of their own choosing that I would never be able to afford let alone want to pay them.

 

I thought TS was trying to stop these companies acting so blatantly wrongly but Mr SG didn't even want to know what the complaint was, he had no idea whether I had addressed it to MH already or what the relationship was between myself and MH.

 

I too doubt they are out of business as, for every person they contact like myself who has access to this site and it's excellent support and advice, there are many others out there who know no better and send them every penny they ask for (and more if the dca's think they can get it!). I know of others who receive letters from MH as they regularly arrive at my parents house for a family member who doesn't live there!!

I will sort out an email to the OFT as soon as I get home from my parents - have just had a begging phone call from them as the pilot light has gone out on their boiler and they can't get it re-lit; not great as I've not long been back from adjusting things in the airing cupboard to turn the heating back on after the summer.

 

Looks like I'm going to have a busy afternoon!!

Well, have got some time to myself once again - family taking up far too much of it for my liking at the moment!! - so have sat down and composed this email to the compliance manager at MH as advised by East Ayrshire Trading Standards............

 

Dear Mr Sands,

 

I am writing to complain about the unacceptable demands made by your company in regards to an account sent to yourselves by the company QuickQuid with a reference XXXXXXXXX.

 

Initially I contacted Sam Gardiner at East Ayrshire Trading Standards who has given me your details as the person to contact regarding my complaint. I had contacted them due to the content of the letter from your company dated 11th October 2011.

 

I wrote to you at the end of September offering £1/month as I am currently in receipt of state benefits and have no other income or assets. In return I received a letter from your company, signed by Claire Thomson, informing me that you require payment of £XX.XX by 10/11/2011 followed by monthly payments of £XX.XX from 10/12/2011 until the account is cleared.

 

I do not understand how, if I can only afford to offer you £1/month due to such a limited income, you think I would be able to afford such inflated amounts.

 

Once again, I make offer of £1/month which is the MAXIMUM I can afford to pay.

 

I look forward to your acknowledgement of accepting this payment arrangement.

I ought to get something sent to this compliance manager as the last letter they sent me was dated 11th Ocober and their demand for payment says first installment must arrive by 11th November!

East Ayrshire Trading Standards wouldn't take any details against MH so I guess I'm left with comlaining to the OFT. I think I'll see what Mr Sands has to say before I contact them!

Something in that letter smacks of desperation to me - they know what I can afford as I told them in the letter they've continued to ignore. Also, they have sent this letter dates 2 days before the date they wanted their first payment as described in their last letter to me from last month!! Am almost enjoying this process and waiting to see what they send me next!!

Once you know they are useless then you can write back in the same vein

 

Dear Mucky Hall

 

Yourself and your clients are aware of the disputes on this debt, perhaps you can let me know which language you want the correspondence translated into if this would help.

 

I state again I am offering X at X rate.

 

And don't forget to date it last week and give them 72 hours to reply or you will formally complain about their lack of communication and understanding to the OFT and Trading Standards.

Hi,

 

Can anyone tell me about Opos Limited?

 

I have gathered they are a debt collection agency based in Scotland - are they anything to do with MacKenzie Hall? I find it interesting that I've been contacted by email by this 'company' based in Glasgow giving absolutely no information other than their own reference number and their contact number, when I've got a disputed debt with MH - they don't want to accept what I can afford them and have set the repayment they want at a ridiculous level based on the information given to them.

 

I have sent this company a reply along the lines of - I have no knowledge of your company or any dealings I may have with you, I do not recognise your reference number as relating to anything of mine, finally, I don't conduct matters other than friendship by email and therefore, if they want to contact me again they can do it by letter - and, if they genuinely have cause to contact me, they will have all the relevent details!!!

 

I look forward to seeing what, if any, response they send me in reply to that email - if they change their communication to letter as requested - somehow I doubt it!!

I am having major problems with them and also in dispute with one of their clients, OPUS are an aggressive debt collection agency who are not interested in sorting out any payment structures that are reasonable.

My daughter had dealings with them and we paid off her debt which was very small (£24) but now she still gets phone calls from them asking for someone called Gail Strong even after me phoning them and telling them to stop the calls as it has been paid.

 

They've called twice in the past week so now i'm going to go to their offices at Ingram House 227 Ingram Street, Glasgow, G1 1DA and demand it stops or i'll be contacting OFCOM.

I have received three telephone calls this morning from these people in the space of three hours. I called them after the first call and was assured that my number would be deleted from the record of the person that they were trying to contact. Obviously lazy and inefficient.

I received an anonymous text from this company randomly asking me to call a number. The text simply read "Hi, it's Jane, can you call me back on 0141 2254200". This is, as I can gather, is unfair conduct on their part.

 

I called back and the client refused to engage in a phone call with me unless I provided details.

 

This company can anonymously contact me and expect me to phone back and then refuse to engage in conversation with me before I provide my details?

My ex boss gave me a cheque for wages, which i cashed in a cheque shop in Scotland. there were insufficent funds available and they then harrassed me for the money when the cheque bounced. I told them it wasn't my problem and that I'd go to the police and report them to Ofcom and the FSA and i never heard from them again as they didn't have a leg to stand on.

They have been hassling me because a former employee of the company I work for obviously owes money somewhere. Sounds like the same man lied when he said the woman had given him the work mobile phone number (I later found out, as I suspected, he had picked it up from the office voicemail message). I refused to give him my name (as I do not wish to be associated with the debt) and gave him a contact number for the person involved but he still refused to remove the firm's numbers from their database. I am seeking legal advice.

we have been receiving calls from this telephone number for almost a year, caller always asking for tina. no tina on our number and we have had the number almost 10 years.

calls appear to be from a call centre but they refuse further details. we have advised on each call that they have the wrong number but they refuse to remove our tel number from their files without us giving our personal details.

we have now started receiving voicemail texts asking us to recall them

I personnaly like to play with these people. Reading back on some of the blogs, they seem to win you up, put you in a bad mood. I recieve alot of these calls for my son who aint lived here for 5 years, asked to be removed ect but they never do as its there point of contact they say!!!!! Well when they ring , I simply put them on hold for a while, when they ask for my details I ask for theirs ,these calls used to get on my nerves and annoy the hell out of me, now with my new approach they are slowing down somewhat cos they know what they are gonna get, and it puts a smile on my face.

The collection team who call you work on a commission basis so if they get money out of you then they get paid, this is why you get threatend and they are aggressive and rude towards you. At the same time they are a debt collection agency just like any other, if you owe the money then yes you will come to some arrangment weather its a personnel one or through a debt managment company. Remember they can only call you 3 times in one day and only up till half eight at night and after 7am in the morning. Do not be frightend in to giving any money you cant afford.

Opos called me and asked me to confirm my name and address, to which I agreed. They then decided that what they actually wanted was for me to just tell tem my name and address without knowing who they were or what they wanted, so I refused.

They got very aggressive and started demanding £263.00 regardless of not knowing that I was who they were after. After getting rather offended that they were prepared to talk about my personal affairs with absolutely anyone I threatened to sue them for breach of data protection and hung up.

Then, a manager phoned me back and started ranting down the phone at me. This is no exaggeration; he was yelling and screaming at me saying that if I didn't talk to them then they'd simply take me to court. I told him to do just that and hung up... unbelievably unprofessional on a level I have never before experienced.

If they think they're getting a penny out of me this side of court then they are massively deluded. I don't deny that I owe the money, but not to them and not to anyone who screams at me in such a way. I will arrange to pay the bill directly with the people who I owe it to, there is a list and they are on it.

They are a debt company and are breaking the law by continuous nuisance calls the best thing to do is record times and dates then report them to Ofcom who can Fine them up to £50,000 for each call hopefully they will end up with debt collectors chasing them .Even if you owe money they have no right to harass you. I have an outstanding rent arrear debt which I have resolved by payment plan with the letting agent directly. Opos have been informed of this by myself and the letting agent, yet they still insist on calling me. Very rude operators who simply hang up on you if you do not give them the answers they want. I would advise anyone being chased by them to call the creditor and complain about them and also to arrange a payment plan with them direct if possible. Good luck.

I just got a call from this number and someone said my name asking if I went to Edinburgh university. I said no, and then they hung up. I searched the number on the internet and found out that they are debt collection agency. The problem is I don't have any debt. I have a credit scoring of over 900 and my only debt is my mortgage and credit card which are both on Direct Debit. I called them back and they checked my number saying they could not find it on the system. They asked my postcode which I would not give them. They kept asking and when I refused saying they have no business calling me or knowing my postcode, they hung up on me :) Why would they be calling someone who doesn't owe any money to anybody?

This happened with another company where they were harrassing me but as soon as I sent them a letter asking for the original contract I supposedly signed, they sent back a letter apologising for hassling me as it was another person they were chasing with the same name. Funny that.

 

What do I do about this Opos people? Any ideas please?

They frightened the wits out of a young girl for college fees. I have written to SFA and opus management re their collector Ryan. I think he had small mind or small man syndrome as he would not accept an arrangement from her, so we have also gone to CAB and Trading Standards

Hi

I had dealings with OPOS and found them to be very rude and they try to bully people to get what they want. This debt company needs to do more customer service training, at the end of the day we do owe money BUT they should be able to deal with the matter more professioanally and have more understanding. I rang the company i borrowed from and put in a massive complaint about their attitude. Which was dealt with. You do not have to take this rubbish of these bad mannered bullies. And if anybody from OPOS is reading this manners do not cost a thing, did your mother not teach you this......

sounds like this is the normal for people who work for this company , i had the same problem, i have not lived at my parents address for 6 yrs, but somehow this compnay got hold of my parents details and have been calling my parents on average 6 times aday, i've called them spoke to some scottish fool called mr jacobs, yes name and shame here. i told him i had not been at this address given him my contact number and address. and they siad they had removed details from the systems of parents, LIES.LIES.LIES, thys still contacted my parents , and when i phoned and had a go with them , mr jacobs shouted that he had every right to contact who they wanted to recall the balance on the account, bt since have blocked number to parents. i have paid the balance over the phone with my card details, funny thing is checked my account, and the cheecky so and so's have now taken a further payment from my card of £500. when the account was paid in full. now they say it was for fees outstanding , bu8t can't proof thisto me, i have spoken to my bank, but can;t get them to re call the funs, as they say it was an agreed tranaction , opos say they can;t find this so called amount they took. 2months later i'm still out of pocket , have been to seek legal advise now, BE WARNED ABOUT HESE A**HOLES , they think they are above the law.

Being chased for a statute barred debt. They have threatened me with court action 4 times in 10 days but Im still waiting, they refuse to accept the facts of the case, dont listen to what is said by the person they call. ... morePersistant aggression, bullying and rude behaviour. Do not speak to them over the phone. Have all conversations via letter as they have lied to me so many times over the phone. They claimed that consumer credit laws and precriptons and limitations laws simply did not exist and that they were fantasy made up by me. I can see how some folk would crumble and pay these savages. I have no bone with debt collectors but they should carry out their job professionally and within the letter of the law. OPOS do not and if you have any dealings with them be very careful but be firm and do not allow their disgusting tactics to cause you to worry. Seek advice from CAB, best thing I did.

I would not allow him to bully me and just kept repeating that the matter is already being dealt with. He should be struck off - absolutely DISGUSTING! The debt he is chasing has already been deemed illegal by the CAB, so they just sold the debt to OPOS!!!

Threats, bullying, intimidation, harrassment and pure lies. They should not be trusted. Make a complaint to the financial ombudson as I have.
