Wow, that seems like a long way off, omollmeg! Maybe mine will be well after birth, then as I started mid-April - eek!!! Could have used the money to get a few things in order before the arrival of Jnr! Hey ho, fingers crossed!

Hi just to keep you updated, I have now gathered all the info needed I think(I hope)

and photocopied it all (3 copies total) all those poor trees!!!!! for nothing!!!

and will send in the post to court and Barclays on Mon..

Any news from you guys???

Basic Court Bundle

 

--------------------------------------------------------------------------------

 

With the banks fighting back harder these days, more and more people get a court date and have to prepare for a hearing.

 

When you get a date, the court will usually give a direction that "a copy of the documents you intend to rely on at the hearing be sent to the other party and the court, no later than 14 days before the hearing date".

 

In the zip file below, you will find a basic bundle of paperwork you want to include. There's also an index of things you should include to help you getting the stuff thats personal to you.

 

Think carefully about your own situation, and adapt the bundle (and the index) accordingly. This is meant to save you looking all over the place for the right information, but it is not a complete bundle in itself!

 

 

 

DO NOT FORGET TO ADD YOUR OWN INFORMATION !!!

 

 

 

You will need 3 identical copies, one for you, one for the bank's solicitors, one for the court.

 

Do not forget to number the pages, so that all parties can find them easily when referred to, and to index the pages correctly (they're xx on the sample provided)

 

In front of each bundle, write clearly and legibly:

 

 

Case Number: XXXXXXX

(JoeBLog) v (EvilBank)

 

Make sure you put everything together with plenty of time to spare. You don't want to realise that tomorrow is your deadline. If you send it off early, there's always a possibility that they will settle faster, when they realise that you are prepared to see this through to the end.

Hi,

I sent all docs off to Barclays & Guildford Court,should I do anything else now or just wait? Should I be calling the court to make sure the docs were recieved?

Any advice welcome as first time been in this situation

Hi Omollmeg, further to your court bundle, I remember reading a while ago a brilliant script advising what to say to the judge in court. I believe that it was by a forum member with "Megane" in the name. Searching for this user has produced no results. I thought I had bookmarked the name but haven't.

 

If any one following this thread knows of this user please remind us of the exact name so we can search for the posts and find this script. It will definately help anyone who has to actually speak to a judge.

 

Anyway things appear to be moving in my claim. More info over in my thread.

HI all,

Just to say that this will probably be my last post. I can't say much(and yes I know I didn't need to agree with confidentiality but it has been a long time waiting!!and with baby on the way etc) but woke up today in a very good mood.

YOu have to do what's best for you, but I can tell you that all you have to do is score out the part relating to confidentiality in the settlement letter. (check my Barclays thread if you haven't recently ;-))

 

Also remember not to tell the court you've withdrawn the claim until the money is in your account, regardless of what Barclays say. By all means, send them an unsigned copy of the letter you'll give the courts, but make sure they know the letter will not go to the judge until they have paid up!
