  1. I am in the same boat right now!!!!My judgement stated I should have been paid "forthwith"....that was on 7th March this year.I have written letters and emails and not 1 reply as yet.Let me know how you are getting on and I will do the same! Sarah

Thanks for the reply, I have read the instructions and I have been in comtact with other organisations over this as my claim is not particularly as straight forward as others.This is why I need to be sure which type of warrant I execute etc.From the information given to me by the court, there are 2 possible methods I could use - plus I could instruct a private bailiff firm to recover the money.I was asking which would be best given my particular situation...the two claims and all the complications asociated with both.Thanks anyway...
  3. Can anyone advise me??? Have a judgement dated 7th March, as stated before....barclays still not paying, despite letters and emails etc - cheeky monkeys!!! :o Which method of enforcing the judgement would be best in these circumstances? (I am also considering private bailiffs as an option if neccessary, at this point.) Initial enquiries have all resulted in the court not being able to advise me one way or the other - due to legalities etc. Any information gatelfully received. Many thanks, Sarah

  5. GOT JUDGEMENT FOR JUST OVER £11K. NOW THEY CLAIM THAT THEY SETTLED FOR £9,900 AND THAT THE AMOUNT WAS TO BE TAKEN OFF MY LOAN ACCOUNT...NOT SO!!! DESPITE WRITING TO THEM AND EXPLAINING THAT THE SECOND COURT CLAIM IS STILL UNRESOLVED AND THAT DUE TO THAT AMOUNT BEING IN DISPUTE, I REQUIRE THE £11K FORWARDED TO ME ASAP BY CHEQUE - THEY ARE STILL CLAIMING WE HAVE SETTLED. ANY IDEAS ON WHERE TO GO FROM HERE? THANKS IN ADVANCE! SARAH:)
  6. Hi, Just wondered if anyone else has had to pay a trial listing fee of £275.00? So far, my court costs are £250 to file, £100 allocation questionaire fee and now £275.00 lising fee. Luckily, all costs can be claimed back!!!!
  7. FURTHER £275.00 PAID FOR TRIAL LISTING FEE. I have also entered my defence against their claim too. Now have two claims in progress between same parties.....very interesting!
  8. New offer - £9,900.00 No confidentiality clause - payment by cheque. Offer rejected - witness statement handed in on 20th December 2006 as specified on court order. Barclays closed all accounts on 27th September ( despite still accepting my loan repayments in November!!!) and now taking me to court!!! Will obviously be resisted in court! Will update soon, when receive any further news. Sarah
  9. You are doing fine - just stick to your timetable and let them sort out their own mess!!! Had slightly similar thing happen to us - seems when you are self employed and they can charge you they are happy. Then when you encounter problems, they just close your accounts and hope you will go away quietly!!! I had many contradictory letters and had them deny knowing who I was even as recently as last month....I'm afraid you just get used to them continuously losing your letters, sending you letters with wrong dates on / no information on etc - I think it's either part of their plan to get you to give up or it is just that one department has no idea what another is up to...who knows!!!! Let them deal with it and continue to get your money back as before! It will all look good in court, should that ever be the case! Good luck, Sarah
  10. Hi connie! My computer down to so am also using one at work!!!! Just for your information, I received defence back on 30th August. Filed AQ on time and have got bundle all sorted in advance. My court date is set for between 26th March and 13th April next year! Depends on courts etc, but don't be too disappointed if you get a date that seems a long way away. I doubt you will have to wait that long anyway! My advice is just to stick to the time table and get everything done asap so that if you do have to hand in your bundle or indeed go to court you will have everything you need in place already. I don't think it will get that far though but better to be safe than sorry!!! Good luck - I'm sure that you will be fine! Sarah
  11. Ooops!!!! Forgot to add that that if I accepted that offer, I was expected to sign that I agreed to keep the offer and it's existence confidential. As I have not accepted their offer, I see no problem with including this on my thread! Think this may explain the limited number of successful Barclays claims on the site!!!!
  12. Hi Guys! Sorry for absence....transferred internet porvider 2 weeks ago and it's still not sorted - nightmare time! Some new news.... Latest offer from Barclays - £9,400+. However, my claim is for £9,707.75 - plus I have paid an extra £100 since to the courts. Then there is further interest to be added on. Within the offer, there is no mention of my defaults / negative info being removed from my credit files as I requested nor have they rectified any of the problems I have had with them. Funniest part of offer - they want to make payment into my barclays account , which they closed themselves back in May. Obviously, offer declined - awaiting response.

  14. Yep...I think it would, but I wouldn't waste anymore of your time or phone bill on them! I wrote a letter back in june stating that my accounts are in dispute, I have money owed to me that is currently being fought through the court, and that due the current circumstances, all contact is to be put in writing and writing alone - I will not enter into any discussions with them over the phone. Any further calls will then be classed as harrassment. This SHOULD put an end to the constant calls, but I wouldn't guarantee that! I also put that if they try to send any outstanding "debts" to debt recovery or similar, they would be in breach of banking code 13.6 as the accounts are in dispute. Worked well for me - but I never thought of harrassing them back!!! Good luck! Sarah
  15. Hi Guys! Have been told that this might be more useful on this forum instead of just on the barclay forum as I originally posted ....so here it is!!! How long have u / did u have to wait from filing your claim until your actual court date? Also, if u can include the name / place of the court u are dealing with, we may be able to see which courts are on the ball and which are swamped - and therefore delayed etc. Many thanks in advance of ur replies.... Let's see which court bags the no.1 slot in the CAG court date charts!!!!! :lol: Sarah
