      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Is HSBC's new tactics to cover their "FEES" now to ring you up and tell you that they have agreed your informal request for an overdraft and that they are going to charge you £25 for it? I received a call like this earlier. I was over my limit this morning, but money went in today to cover it (Hubby's wages that gets paid in every Friday and have done for the last 12 years) I pointed this out to the person. She hung up on me!!! Very unprofessional in my opinion.

That happened to me and I told them I wasn't happy as I had agreed to nothing and asked them to refund the charge as I did not want to have to start another claim agaist them! The refunded it there and then!

That won't be happening to me for a while now!

Im amazed... you could actualy understand the person on the other end of the phone ??? HSBC must have invested in an english teacher in Bangalor.

 

If anyone thinks thats racist im sorry, but I have a basic need to understand the person im talking to before I can do any business with them. I have found if you depart from the script cards the Bangalor staff work from (maybe used to work from) they havent a clue what to do.

 

For the last two years I have refused to confirm my security details over the phone, told them if they need to contact me to write a letter. If you dont confirm your details they are not allowed to talk to you by law and as it happens I have had no letters as the result of one of these phone calls.

 

thats urgent then...

Nope. Not at all. There are many dummy books on the market eg Diabetes for Dummies etc. (I bought that one for my Father in Law)

Just phoned my local court as I hadn't heard anything regarding my directions thing I sent to them. Apparently the judge does not do directions prior to the prelim hearing. I also asked if I need to bring anything on the day. The lady says "No". They only need a copy of my schedule of charges of which they have got. Shall I do a bundle just in case?

Think the Judge just wants to see if DG turn up, if you have been told he/she wont want to see anything it sounds like he/she will strike the defence if they dont show.

 

I would take all of your corespondence just in case though.

Just a little question for you guys and gals. When I prepare my mini bundle for court, as they have not actually requested one, do I still send it in 14 days before the hearing and also forward a copy off to DG?

well, we've said before - the bundle is a great nudge -

i'd be inclined to send it to dg with a cover note - basically saying - see you in court - unless you want to get in touch (not quite those words) - 14 days before the hearing date.

 

just so they know that you know what you are talking about - i'd put something like: although no court bundle is actually required in this case - I am sending you the information which will accompany me to the preliminary hearing....... or something like that.

I took your advice and have just sent my bundle off. Rang the court and they laughed when I asked if they'd complied with the Judge's request to send in a breakdown...

 

Have you sent your mini-bundle off yet? I ended up doing the whole thing because I already had most of the dox from my other HSBC claim.

 

My letter went along the lines of:

I refer to our hearing in this matter which is scheduled for ...at ... County Court.

Although this matter is listed for further directions and preliminary hearing and a court bundle is not required at this stage, I am enclosing a bundle which contains all the information and evidence that I will be calling upon at this and any future hearing.

I understand that you have failed to comply with the Notice dated 14th May whereupon you were requested to file and service full details of the costs of each and every one of the charges levied.

 

So, let's wait and see shall we?!!! Fingers crossed this gets things moving.

Thank you Pete for your truly uplifting optimism. I am desperado for the cash at the moment so it won't come a moment too soon. The last claim for HSBC paid out 24 hours after I sent the letter home, so here's hoping...

Hi I sent my Bundle last monday, and today got my full offer with full stat interest & costs, court hearing date was 11th july, so even with the postal strikes delaying it. Just checked franking machine post date 29th june, so was sent on friday, but may not have been picked up till later. Keep faith it will come ( easy for me to say that now, i was beginning to wonder myself LOL)
