      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Still trying. I have searched ebay. I can get an old paying in book for Midland Bank and that is about it.

Hi Jowalshy,

`i notice your direction date is 25 July, mine is nearly a month before yours and you are getting your court bundle together?

I know I received some really good advise frome you yesterday but do you not think if I get this done and send into D&G it might push them to make an offer?

I am slowly getting bits together for my court bundle. I think the court bundle has to go in 14 days before the hearing/court date. As for sending it in early to DG, I can't really say whether it would push them to settle earlier or not as it won't make the court date any earlier. You could always send a nudge and say in it that you have your court bundle ready to send and would they please provide a name and address of the person who it needs to be sent to.

Sharongina, if your court date is nearly a month before JWs you should be getting an offer shortly I would guess. They are settling now about 2-3 weeks before the hearing date. Also, if it's only a directions hearing, you shouldn't need a court bundle at that stage.(but check with the court).

 

JW - you've got ages yet before you need to think about a court bundle - chances are you'll never need one and it's an awful lot of work for nothing - they reckon an average of 200 sheets x3. I've had 2 settlements now and never needed one. My advice would be - leave it for a bit yet.

(having said that, I'm not an expert - you need Latty, or Pete for that ;) )

As for the hearing date. If you do by chance actually go to this hearing you really need to prepare for it. The court may not have asked for anything to be brought to the hearing, but I personally think if you have all the necessary, then you are prepared just in case. It's good to be ready -I was going by my experiences, but different courts go down different paths.....

think of the trees. Its a shame you can't just bung everything onto a disc and get the court and all to use a computer to see the court bundle etc.

many of you know that I have T&C's from 1996, but is there anyone out ther that can tell me how to put them onto stax's new thread? they are in zip files. I could just cut and paste them on here, but I think that might break a few copyright laws and I don't want to do that.

I think that the best thing would be to put them on the bank fodders thread in the info part if you sould do that aswell freaky. That way the thread doesn't vanish.

Jowalshy I am not to sure it was either 1995, 6, 0r 7 I opened an account think (midlands) how do I find out?

Do I ring the Bank? and will they give me the information?

 

It is so frustrating now, I hope I win this as I have already spent the money in my head!

hi Sharongine, I just went into my local branch and they told me the date, as long as they can identify you over the telephone they should give you the info. no problem without you having to give a reason why ( I used to work for a bank for my sins but was a minion not a boss person):)

Hi Pete, here is the link. when I click on it, it brings me to a page where I can choose which bank etc. When I click on view, it brings up a very faint spreadsheet of all the settled claims. when I print it out I get a blank sheet of paper.

Im getting the same Jo think we need to ask a Mod about it.

 

Well I had a reply to my S.A.R - (Subject Access Request) from MBNA saying they were sure their charges were fair but heres a cheque for £80 as a good will gesture. I wrote back saying this is not what I asked for or what they were bound to provide by statute heres your cheque back now give me the info

I banked my first cheque and then a few weeks later they sent me the rest. I am having a bit of bother with them now regarding the S.A.R - (Subject Access Request) stuff they sent to me. I wrote to them asking for clarification of a few things and all I got in reply was another schedule of charges!!! And this was after they had paid out!!!
