HSBC said that in order for me to have a cheque they have to pay the money into my account and then take it out again. They then said that a cheque has been issued today. Hopefully I will get it first thing Monday morning (if Royal Mail behaves itself). I will now ring the court and ask them what to do regarding my hearing on Wednesday as I do not wish to cancel the proceedings until the cheque has cleared.

I have now rung the court and was advised to adjourn the hear

ing to a later date in order for there to be time for the cheque to clear. I have drafted up a letter can someone have a look and tell me if it is ok:-

 

 

Dear Sirs,

Re: Preliminary Hearing – 25th July 2007 at 10.00am

xxxxxxxxxxxxxxxx – v – HSBC Bank Plc

I am writing to inform you that I have received a full offer from the defendant in relation to the above claim. I have requested that the payment to be made in the form of a cheque and have been told by the defendant that this has been sent out to me today. Unfortunately I do not wish to end proceedings with the defendant until the cheque has cleared through my account, so I am writing for an adjournment of my hearing to a later date in order for the there to be time for the cheque to clear. Once the cheque has cleared I will then notify you.
