Hello,

i need advice on what to do about my children and ex-partner who is going to prison for 6 months or more for assault.

she does not work and lives in social housing with my 2 children and another younger child from another relationship that has since finished.

she wants me to leave my job and private rented 1 bedroom flat and go and live at her 3 bed social housing house until she gets out of prison..which of course i will not agree to as i am not on her rent book, i dont have a car to get to work and she lives over 30 miles away.

i would like to know how i go about getting custody of my children so they can live with me? (a boy and a girl) how i can get them to a local school so they can go to after school clubs so that i dont have to finish work early?

would i be able to get social housing as we cant all live in a 1 bedroom flat that i privately rent?

do i have to get advice from social services?

 

any help please.

its not something we deal with here

you need to go see a specialist solicitor.

surely social services are already involved?

a custodial sentence is not handed down to single parent without reports being done.

have you approached them or been involved in this to date?

i think they have been round but not involved.

she hasnt been to court yet but they reckon she is going to go to prison for 6months or more.

ive not approached social services and not been involved...i take it i should contact social services then?

the court will not hand down a custodial sentence without social services being involved and producing reports upon the children and their future welfare first .

courts will /must know her circumstances and her living arrangements etc etc  before handing such a sentence down. they dont 'just do it' then simply say kids go into care/homes or WHY.

i would be approaching social services.

it is also worthy to remember the fact of their future with you after this period, if you look after them or not now will be a totally sep matter.

i will also guess they will not allow the 3 to be split up either.

so you need to think about the child that is not yours too.

Agree that Prison is unlikely unless previous serious offence history.

And social services will be involved in making decisions to ensure most appropriate care for the children.

We could do with some help from you.

What is the story behind this person?
Six-month prison for a first offence seems pretty serious to me.

On what basis has she been told that she will be given six months?
She must have some previous and possibly she is in breach of a suspended sentence?
