Hi,

 

Please help me

 

I received a parking charge Notice from CPM

 

I sent back a transfer of liability to them(with name and address of the driver at the time)

as I was not the driver at the time the contravene occurred

 

I have received a letter from CPM stating that they are unable to process the transfer of liability as they have not been supplied with serviceable address

 

The driver lives abroad.

 

What do I do please.

Totally agree with DX here.

 

You supplied a perfectly valid address. It doesn't matter if it was overseas or not. You have fulfilled that obligation to supply so they cannot chase you.

 

If they continue, Complain of harassment.

If you are asked to deal with any matter via private message, PLEASE report it.

Interesting. What's to stop me having a maps search on the internet for an address overseas in a non English speaking country and providing an address and name of my 'Pen Pal' who was over visiting that week?

They want some money and dont care who pays them.

 

 

It is unlikely that they will try their luck in front of a judge on this one

but keep us informed about any more begging letters you get.

 

 

there is no keeper liability under the POFA as long as the address you gave is a valid address that legal papers can be served in the UK, EU or any other co-operating country (most of the world).

Utter rubbish from the PPC, document looks extremely unprofessional and I would ignore anything else from them as you have supplied the name and address of the driver at the time and that's the end of the matter as far as you as the registered keeper is concerned.

Absolutely agree. Total rubbish. You have supplied a serviceable address. The fact it isn't in this country is not your problem. I would love them to try this on at court as in my opinion, they would fail miserably. It is NOT your responsibility to contact anyone. It's a shame they are members of the IPC and not the BPA. You could complain to the IPC about one of it's members but they will do nothing as it is an old boys club. The BPA would investigate.

 

Couple of questions. When you transferred liability, did you include your home address? Have they written to you at this address?

they are hoping that by claiming you havent transferred liability somehow it falls upon you.

 

 

No it doesnt, the keeper liability only exists in specific circumstances and it is not a default position.

 

 

However, you didnt say whether the driver address was in the EU (or NZ, AUS, etc)

which would really sink their claim even more than their own words.

 

It would be helpful if you tell us this becuas then we can advise what to say should they start getting the lawyers involved.
