hello just me :) im in newcastle too, dependant on the area you are in i would be able to come along for moral support if it need be, ill also check out the local cab centres for you :)

I went to court today, I have the date 2nd July for Weds. Fingers crossed. I will let you know how I get on, many thanks to everyone for your help. I am going to see if there is a duty solicitor on, on the day to see if I can get any advice :D

 

Honey, would you be able to com ein the court room with me? Im nervous as hell

Hi, there is no reason why Honey can't accompany you - you are allowed to have support.

 

The process is not as intimidating as you might think, it will be held in a private room with just the judge, a representative for the other side and yourselves. As you are making the application the judge will hear your side first, if you have to address him/her it is Sir or Madam. He/she will realise you are nervous and guide you through the process.

 

When you have made your payment on 1st July get a bank statement to show that it has been made and copy it to take to court. We can then draft an up to date statement for you to take with you to court.

Hi indistress

 

Just want to wish you luck for next week. You are in good hands here. Ell and the gang helped me through two eviction hearings this year. The judge will be kind and like Ell-en said you just go into the judges office. I understand what you must be feeling like at the mo and it is easy for me to say but please try to stay calm for the time being.

 

Good Luck and I will be keeping a look out for the results

Hi Indistress,I'm afraid I don't have any expertise to help you with this but would just like to offer my support - I hope it all goes well.I did hear on the news that in light of the Credit Crisis courts are expecting lenders to be much more sympathetic and I think would be willing to do as much as they can to help you.Good luck xx

Hi

 

I have already got a suspended order for my mortgage account,

and I have fallen behind in my payments due to being on the sick with PostNatal Depression.

 

 

I wrote a letter to them on the 4th July, asking if I could pay my normal £100

and an extra £100 to clear off my arrears I caused.

 

 

I sent it recorded delivery, they received the letter and I got no correspodence off them, till today (6th August).

Stating that they are proceeding with eviction.

 

 

I phoned them up, and the woman on the phone stated I have not responded to their letters and phone calls,

they were going ahead with the eviction unless I pay £2000 (rough figure) off.

 

 

I recieved one phone call of them on Sat 2nd August and I missed the call as I was still in bed (9.15am)

and the first letter I recieved was today (6th Aug).

 

Was wondering would they be able to evict as it is my main mortgage account?

Ive already been down this road for my 2nd mortgage but it was suspended.

 

I have 2 children 12 year old and a 8 month old baby, and I am worried for my family.

 

Any help would be much appreciated.

Hi there, as there is no eviction warrant yet, your best action would be to make payments as you have proposed in your letter. If they do go for eviction we will defend as we did last time. I assume you have the printed signed for receipt for the recorded delivery and a copy of your letter? we will need them to prove you have tried to come to an arrangement.

 

Just a few questions: are you saying your normal monthly mortgage payment is £100 and you are offering a further £100 on top of that towards arrears? i.e. £200 per month?

 

If you do a budget sheet does your income and expenditure show that you can afford that payment?

 

Try not to worry too much :) - I am sure we can defend this OK, given your circumstances.

My normal monthly mortgage is £420, in my last court hearing I was told to pay £100, I have offered to pay an extra £100 on top of that so I would be paying £620 per month.

 

I dont think I have the receipt no more oooppps :( But I do have a copy of the letter

Do you have the red recorded delivery stub from the post office? If not, not to worry. When did you last make a payment and how much & when are you next making a payment.

I have a look for the receipt but Im sure it got thrown out, I was going to pay last month but then my wages was short, so June was the last £100 I paid. Have to check my statement to be sure. My mortgage is still getting paid I havent been missing that just fallen behind with the £100's and I am 2 months in arrrears from the beginning of the year.
