Hello all

 

I have been having a problem with O2

 

I defaulted on a phone contract

. They have now passed it to Westcot.

 

The contract was one of the newer contracts which gives you a contract for the phone and a separate agreement fro airtime

 

. I am not denying the debt and want to pay O2 but they keep referring me to westcot.

 

from the library I sent them the cca request and the reply have come back which I have uploaded

 

. I just want so advice what to do next.

CCA req does not apply to mobile contracts.

 

If you want to resolve this debt you will have to sort it out with Westcot, as the account has been sold or contracted to them. But you could ask for copies of 02 statements of account from Westcot to verify the amount owed.

That was my mistake as I thought I signed a credit agreement with O2 when I bought the phone. As they now give you a 0% loan for the phone and a separate agreement with the airtime. I willask for the statement of account

I disagree and this needs to be taken on a bit more of another note.

 

The OP needs to find out how much the balance is comprised off in this case. Wescot are correct in the sense that a CCA request wouldn't apply to the account, but only if all the charges were made up of AIRTIME only.

If it includes the Handset agreement too then it means that the balance has been lumped together. If Wescot cannot provide the CCA Agreement then the balance that should be paid should be Airtime minus any amount that has been applied until the CCA is produced.

 

Even then, Id tell Wescot to go( removed ) themselves. They are a pain. I suspect its just be assigned out to, and not purchased by Wescot. If you want to pay O2 then you still can. As long as you have the account number etc then you should be fine. Pay them by SO

 

But also email ; Ronan Dunne

 

 

Complain, tell them you are unhappy with dealing with Wescot and that you wish to pay direct to O2 which you should have a right to.

I will email o2 and complain. Should i resend the cca to and tell them if they do not produce the cca and a break down of accounts then i will put the debt into dispute.

If there are parts of your contract that come under the CCA, then simply ask Westcot whether any parts of the debt fall under the CCA and if so to fulfil their legal obligations in providing information required under the CCA. This should include a copy of statements of account from 02 and a copy of any credit agreement for the account.

 

I would not go threatening putting the account in dispute, as for any contract that comes under the CCA taken out from April 2007, they would not need the CCA to go to court. They would just need to evidence you owed the debt.

If the wetcloths letter says o2 are their client

 

Ignore them

They are powerlesss and are not. Bailliffs

Unless they own the debt

They have no legal powers

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Also of note is that if o2 own the debt, then they cannot refuse payment towards the outstanding amount. They can refuse a payment plan, but if you call and tell them to take payment they CANNOT refuse to do so :) This also stands in your favour should the debt go to legal action

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
