do i just reply indicating i believe it is incomplete or should i refer to specific documents?

 

You might want to mention one or two documents so they know that you know they are actually missing :) However, remind them that a Subject Access request is for everything they have that pertains to your relationship with them and you WILL make a complaint to the ICO if they fail. Give them another 14 days to complete your request.

hi

 

just had a separate letter from lloyds with respect to my sar request and part of their letter reads 'whilst we have conducted extensive searches, the agreements for your loans are not held in a relevant filling system and the original signed documents are unable to be located'

 

i'm not sure what to do next?

notified valuer re missing docs....had reply next day with one more document but missing the crucial docs, which they now claim they have never had yet they are in the valuation report... in laymans terms this gets more and more dodgy :!:

hi everyone

 

are there any procedures that lloyds have to follow when opening a new loan for over £100k? i know there are guidelines they have to follow with loans up to £60k but over that i don't know!!

hi all

 

submitted my 'complaint' to lloyds re their conduct etc etc, it has been passed to customer services who will have their full and final response this week. they have then pointed out that i am then at liberty to go to the fos etc. however as you have pointed out on this post before is this response the same as writing to lloyds head office?

so you are telling me that if they can't locate signed loan agreements, terms & conditions, complete instructions to valuers etc etc i should just sit back and accept everything. it seems to me in order to escalate matters my issues will have to go legal so i can go for full disclosure....

no, not saying 'sit back' at all. (my posts seem to often get misinterpreted! maybe my articulation? :) )

meant if they actually 'deliberately' do not have any docs, then a dsar won't produce them as you said.

but, it just seems 'convenient' that they are not there. if you see what i mean.

not really!!

 

the bank is sitting on a increasing debt at ridiculous interest rates. why should i just sit back and let them rely on their security especially as i believe there has been serious misrepresentations on behalf of the bank from valuations to forced signatures on mortgages and no signed loan agreements and no t&c's. surely i should be going on the offensive??

don't know what else to say now. :)

don't be fobbed off by any unjustified excuses ( you have the info re what should be in a dsar)

and posing the q whether maybe they have 'deliberately' avoided things? being cynical.

one option re full dsar non compliance is a complaint to the ICO.

and, as you say, if nowt else, consider further action, including legal.

ie don't just 'sit back'?

just heard back from bank re 'my complaint' they have ignored everything of a serious nature but have admitted they can't find the original business loan forms and have offered me a token payment as a result. correct me if i'm wrong but if the loan is for over 30k then it has to be signed and executed to be binding?

just an update, did another dsar request and low and behold documents turned up that couldn't be located for 4 years. importantly they show that original plans had been altered by the bank and then given to the valuer in his instructions. he has then valued property for security purposes for my borrowing and guarantees etc etc

 

best way forward???

hi everyone

 

catch 22 position!!!

 

i have a loan with a bank.

 

 

bank has charge on property.

 

 

i dispute nearly the full amount especially as the amount has tripled over the years.

 

 

bank has failed to mitigate its losses.

 

 

they write to me every year informing me the amount has increased.

the security they have is worthless and they admit that.

 

 

i am on jsa and can't afford any payment to them.

 

 

they have asked me to enter into negotiations but they want too much.

 

 

i have told them i will defend their claim if and when they bring one.

the problem is they have indicated this will never go that far.

 

my question is

 

 

how do i dispute the debt,

 

 

i have complained to the bank with evidence and they have ignored the lot.

all i want is this to get to court,

 

 

can i do that,

 

 

can i issue some sort of claim to dispute the sums?

i have a large bank loan outstanding which for years my bank has not looked to enforce.

 

 

i have argued that the bank has failed to mitigate its losses,

 

 

obtained the loans by misrepresentation and countless other matters that the bank behaved wrongly.

 

is there anyway i can challenge the loan?

Hi

I'm afraid you are going to have to give us more info. Nothing to go on with what you have said so far.

 

How old is the loan?

Are you still making payments on it and if not, for how long?

why do you feel that there is misrepresentation?

What losses?

If you are asked to deal with any matter via private message, PLEASE report it.
