This is the best news I have had for ages.........tho I hope they dont withdraw their licence quickly.............I have a claim to start with them and dont want them using that as another excuse not to comply !!

well,I can only take it that the OFT have kicked citi up the ar$e about all the telephone calls,because they have stopped!!HURRAH for the OFT!! :D

 

I sent a letter to citi the other day(Brian,if you haven't seen this letter at CITI you can read about it here,because you kindly informed us that you were monitoring the site......ahem

 

 

they sent the mrs a default notice(stupidity sans frontieres)which they were told

what they could do with,and again we offered CITI the opportunity to settle without going to court-even at this late stage.We await a reply.

 

CITI-fair warning-we are armed and completely ready for court-do not doubt that we will take it into chambers to be settled if you refuse to see and admit to the error of your ways.....

I have just recieved a very patronising letter from Brian Smith about all the ongoing issues I have with citi...listen to this for a kick off!!

 

He tells me that I "do not have the right to determine the manner in which I am contacted for the purposes of debt collection activity.The have the ight to contct me by the most appropriate means available to it and not those dictated by myself!!!"

 

He also tells me that I am in the wrong by going to the police,and not the ICO.

 

He also tells me my case is flawed and -

1.under case law his client "may have erred in the amount of charges it levied on defaulting accounts" but that failure does not "as you appear to believe,absolve you of your own repeated breaches of the contract"

 

(I THINK HE HAS JUST ADMITTED LIABILITY!!!)

 

"It merely means that you are entitled to relief from the penal element of the clause in question not that the clause becomes unenforceable"

 

He goes on to thank me for the opportunity to again settle out of court,but that in the terms it is framed,it appears I am "looking for capitulation rather than settlement"He also offers to refund me the court fees as well as the difference between the charges and the "OFT limits"......

 

 

How dare he lecture me on my rights-a suitably pithy response shall be winging its way to his desk at the earliest!!!

looks like citi want to go to court on tuesday-not a word since I replied to Brian Smith's letter.

 

If they do want to settle,it will be a total panic session from citi on monday trying to get it sorted......

 

Why do they let it go down to the wire if they don't intend to defend?Maybe they do actually want to appear.or maybe they just won't turn up.....who knows?

 

Anyone know if they have actually gone to court?

We know Citi have been reading these threads.

 

Btw which part of the country are you ???

 

if you are too far from Manchester they may want to defend by telephone (as they have asked for in another case )

I'm in Northern Ireland-I think they are on a beaten docket for defending by telephone....I would object most vehemently,especially as they have tried to threaten the individual by suggesting they could have the hearing in Salford.

 

Brian-if you're watching-I'm ready to go!!! :D

he is probably over here this weekend anyway for the golf and will just take a stroll up to Craigavon on tuesday morning. i think at this stage you will be glad to have your day out and actually get to meet some of these people.
