Hey everyone, in 2011 i was employed by a construction company and sent to college to do a HNC in building studies costing 1200 per year.

In November, (my second year at college) i got made redundant due to the business not doing so well. My previous managing director and owner of the company told me he would pay for the college course as he had already paid for the first year.

Two months ago i started receiving letters from the college asking for £1200. It is in my contract with my old employer that he would pay any college fees and he is refusing to do so and now the college are saying its my responsibility.

i left college after being redundant so i only attended for about one quarter of the second year yet they are still chasing the full cost of the course? i have a copy of my contract of employment on my computer which my old boss emailed to me in the job offer back in 2008 yet it is unsigned as the company received the signed copy which i printed off.

What should i do? i really need advice! worrying about it as i cannot afford to pay 1200 and i don't want a bad credit history?!

Thank you for reading any help would be amazing thanks

I have flagged your thread for site team.

If you have a contract advising that the firm is going to be responsible for the fees, I dont see how the college can chase you. But others will advise for sure.

Hi, did your company give the college a letter stating they were responsible for paying the fees? I deal with this sort of thing in my day job and we always have to give written confirmation to colleges stating we are responsible.

i am unsure, every time i contacted my old employer he said he had sent a letter and will pay the fees. When i have phoned the college one of the staff said they had received a letter and other times when i have been in contact they have said they cannot find one :/

I think you need to write to your employer asking for a copy of the letter and also formally write to the college stating you are not responsible and that they have received a letter from your employer (send both letters by recorded delivery and keep copies for yourself together with the recorded delivery receipts). If you need help with the letters please let us know.

Have you got a copy of your enrolment for the HND & the terms & conditions of enrolment. If so check to see if ther is anything in them about you being responsible for payment of fees if employer defaults.

  • 4 months later...

The thing with creditors is, they can never refuse any offer you make. simply tell them you can't pay it all at once and try and work out a payment agreement. The only way you will get credit history is if you make an agreement and fail to keep it. Hope this helps.
