A court "summons" is an invitation. Yes, if you don't attend they will arrest you, just remember it's an invitation so there is no need to be nervous!

Hello again. Obviously I don't know as much about the law as you do, but I'm not sure how setting yourself up to be arrested is helpful.

 

And couldn't the case go ahead in your absence?

JC is clearly confusing civil and criminal matters

 

The offender who travels without a ticket in the knowledge that a fare is due and only intending to pay if asked to do so may be charged with an allegation of a criminal offence (RRA 1889 S.5.3.a - Corbyn 1978 - Judgement of Lord Widgery, Justice Cumming-Bruce and J Park)

 

An offer to pay at a later time will not negate the liability as the Act is clear in saying '..having not previously paid...'

 

The same logic applies in the case of a breach of Byelaw where the matter is a strict liability requirement. Where facility to pay the correct fare is available the traveller must be in possesion of a valid ticket.

 

The unpaid fare is not a civil debt.
