Ok well thank you all for the advice I will be getting letters printed off and sent align with contacting the agent telling her what you have advised me to do!

Hi the letter they sent me was dated march 2011 and says : let provident help you make a fresh start

On 18th march 2011 wescot appointed provident to collect your outstanding debt to vodafone of £373.50 and a friendly local agent will call at your home to discuss payment options with you!

We could help you pay less

We understand there may be many reasons why you have been unable to make payments with wescot in the past and if you cannot pay the full amount now we may be able to help!

With provident you could actually pay less than you currently owe spread over a term which is manageable to you.

Details of the interest free loan we can offer you are given below. These are purely illustrative and subject to affordability. This offer is only available until 8th April 2011 don't miss out!

Debt outstanding: £373.50

Provident reduced amount: £335.00

Service charge: no charge

Weekly payments(25 weeks): £13.40

Weekly payments(50 weeks): £6.70

Apr: 0%

Representative apr: 0%

If you are interested in the new repayment plan and sign request to call a provident agent will discuss the plan with you. The debt with wescot will then be settled upon entering the 0% credit agreement with provident.

All other issues aside, if you genuinely owe the money (and I know you are not sure) and if it is enforceable, thats not a bad deal! No interest, no charges and a reduced balance paid over a year - maybe longer. But clearly you need to know whether you really do owe this and if so, that it is not statue barred

Send the letters i previously suggested to provident.

Other than that, you do not need to do anything other than letting the person that whats to meet you that you will not be meeting her and shes not got permission to come to your house, as so, if she did come to your house she would be deemed as trespassing and you will call the police. That's all you need to do for now.

these 'fresh start' letter have been discussed on here before a few months ago

 

THEY ARE A FLEECING EXERCISE, designed to get you on their books..

 

do not take up the offer..

 

there is no issue here if its enforceable or not

 

there is no credit agreement involved.

 

so as TB2 says please

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

To update, I text the woman from provident stating: After seeking advice I will not be meeting you this evening (Tuesday 3rd May) and I have sent letters direct to provident regarding the matter. Could you cease all calls and texts to my mobile and parents landline and I deem this harassment! Also, any home visits will be classed as trespass and in each instance I will notify the police. I require all further correspondence from your company to be made in writing only.

 

She replied by texting:

Hello sorry if i have affended u i was only trying to do my job.All paper work will b returned to main head office but it could come back to provident in the furture thanks

 

I also posted this morning the letters you advised me to send to provident!

Well if you acknowledge the debt as yous, then Vodafone in my opinion given the circumstances should close the account at zero balance as a goodwill gesture. Though they may deduct part of the outstanding amount from the balance and make a repayment plan with you for the rest. Though like i said, given the circumstances, i personally think they should close the account.

 

Anyway, so long as you make no payments or acknowledge that debt was yours, which you haven't so far, and as it till needs to be proved that it is actually your debt. Then in a years time it will be statute barred, so you wouldn't have to pay anything then.
