im getting the same emails bouncing back and phone ringing out i have been searching to try and find out who the number belongs to and who owns the radiaror company becoute when i phoned that company when i asked for mr walker he was very off with me so maybe they are linked because he would have to use a address that his card is registered to in order make the website something im going to look into

Yes its possible,also possible that he has been getting many others calling for the same reasons.

But there does appear to be an established link.

I have posted on yahoo answers so maybe will get people seeing this there too.

Ideally it would be good to find someone in that area who maybe could physically go and check things out.

The other thing I noticed is that on a google search-inputting console repairs scotland brings up quite a few names-1 or 2 are very much established businesses.

I might try calling those as I am sure they will now have picked up on this.

You can actually zoom in on the exact address (No 6) on Street View. Also, they are not registered with Companies House. The building itself is number 6, but there are obviously a number of flats inside. That alone (No actual flat number, just the building number) would have me worried.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

just a update i have now contacted tradeing standers glasgow and my local office and i had a email of the legal department at 1and1 and they have tried contacting him but they have give him until Wednesday 26th January 2011 at 10am to reply before they cancel the contract so the website cannot [problem] anyone else has anyone else reported to tradeing standers?

Not had any reply to my complaint via abuse at 1 and 1.

Tried to call them but says all operators busy.

I too have fallen for this [problem]. Ordered a refurb ps3 on 14th Jan for 99.99. Got suspicious when i had no replies from any of my emails and when i dug a bit further and linked up all the names and address contradictions. Have escalated to a claim with paypal and contacted my bank for a chargeback. I would have thought though, he could be traced via paypal as he surely would have given bank details to withdraw our money?

 

Either way, gutted i fell for it all and glad that im not the only one....well, not glad but you know what i mean! I also replied on the yahoo question thing...

Yes I think many will be covered under section 75.

Like you say,paypal should have things in place,but saying that,I have read that they have a few restictions on refunds.

You must be one of the first to be hit with this-14th.Jan he was still responding to emails for enquiries after this.

I think my initial one was on 17th.

Why I did not see the red flags I dont know-I should have known better since dealing on here since 2006.

I am more annoyed with myself than Mr.Walker ...........

I am more used to spammers using these kind on email IDs than [problem]mers.

I did think actually it was appearing to be representing a postcode.

A online guide on how to check a Retailer online is whats needed, does it tick all the boxes? I ordered some thing from Chemist Direct a couple of years ago, they were out of date, so I sent them back. I noticed that they had charged me twice. They have to date only refunded one set of monies. Regardless of the communications I have had with them.

Hi Martin

 

The items were £21.50, they debited £43.00, I returned the items (Glucose testing kits) The packaging indicated they have been around for a long time, they were out of date, didn't mention they were out of date on their site. A couple of months later I noticed that it had been debited twice, they promised to refund the monies. I've even spoken to them just before Christmas, same thing. I've sent them copy statements. The person I spoke to a couple of years could see that it had been taken twice but only refunded one amount, it tell's you the type of people you are dealing with. I've got all the names and E-mails phone call etc.

 

I might do the court claim. I'm going to say sorry to the Judge

for wasting the courts time, as the Retailer has done nothing to refund my money even with my best efforts. This company actually had the BBC logo on it's home page at the time of my purchase.

 

I need to pick my battles as I'm dealing with quite a lot.

I am able to report a response from Consumer Direct.

 

 

Dear XXXX

Thank you for your enquiry to Consumer Direct dated 24/01/2011. Your reference number for this case is XXXXXXX and should be quoted in all further correspondence regarding this case.

From your email it appears you ordered goods which you have not received, the trader is now not contactable.

Based on the information you have provided the key legal points in response to your enquiry are as follows:

If the trader is unable to comply with the terms agreed with you, they may be considered to be in breach of contract. As such, it may be possible to pursue a refund. You may find this difficult if the trader has ceased trading or you do not have an address to write to.

If you do have an address, you should send the trader a recorded delivery letter, outlining everything to date, and giving a deadline to resolve the matter within a set period of time (i.e. 14 days). Make it very clear what you are claiming from the trader. It is also worth retaining copies of everything sent, for your records.

We would also suggest that you track the letter using the proof of postage the post office will supply you with; to make sure the trader receives the letter.

Your email does not clarify how you paid for the goods. (paid by paypal they obv missed it) If you paid by credit card, you may make an equal liability claim against the credit firm under section 75 of the CONSUMER CREDIT ACT 1974 (providing the purchase amount is over £100) if there is a breach of contract.

 

It would be advisable to send a separate recorded delivery letter to the credit company, enclosing copies of all correspondence sent to the trader to date, with a full outline of events. You will need to state that you are holding the credit company jointly liable for any breaches of the contract, and request their assistance in bringing about a satisfactory conclusion to the matter.

If you paid by debit card, you may be able to seek a refund through the debit card issuer if they have a 'chargeback' scheme. You should submit your claim in writing to the bank, specifically mentioning the 'chargeback' scheme, and asking that the matter is resolved in a timely manner.

If you paid using PayPal or any other party, it may be worth discussing this matter to see if they can offer any assistance in accordance with their terms and conditions of service.

If you do not receive a satisfactory response or if you require any further advice or information about this case, please do not hesitate to contact Consumer Direct on 08454 04 05 06 quoting the case reference number.

Am left wondering why Glasgow Trading Standards ref;d me to CD only to be told something I already knew.

To me GTS should be intervening since the facts are that we have a trader in their area who has been doing business on their doorstep with no regard to the law,or intention to give customers what they have paid for.

What is to stop him doing this again if nothing is done in Glasgow ?:???:

xxxxxxxxxx has quite a good guide xxxxxxxxx

 

They're affiliated with xxxxxxxxxx but I'm sure if you pinged an email accross to one of their admins they allow you to use it.

 

Personally for everyday goods my 1st port of call is always xxxxxxxxxxxxxx for a WHOIS/IPWHOIS Lookup to check for the websites UK registration and date of. Newly reg'd or on UK then I'm out

 

Followed by Google for reviews etc

 

For some specialist stuff where a non UK site is often needed then I look round related forums for suggestions of who they're buying off.
