Hi, sorry for the delay had family visit over the weekend. I'm at work at the moment but will try and do the letter in the next hour. Can you take a photocopy of the bill for the repair of the machine, we'll send that with the letter.

Letter affixed. Enclose the photocopy of the bill for machine repair. Make sure you take a copy and send by recorded (or special) delivery, also make sure you have the correct address. If necessary ring them and ask who to address the letter to.

You said you would be making a payment today so you need to fill in the amount in the letter where I have put XXX's.

hi ell-en

just to let you know i got a call from capstone today who have kindly agreed to let me make payments at the end of each month . can you believe i asked them 3 times and they kept saying no . it took your letter to persuede them, so thank you very much .

They also sent me a detailed breakdown of charges added to the arrears at it comes to an astonishing 4,000 pounds .

Oh and theres more the last 3 payments i made them (debit card ) they have deducted money from that and paid the building insurance ,so now they are saying i am 300 pounds behind on my payments . Is that allowed?

They've charged you £300 for buildings insurance - that's out of order, you could get your own insurance for fraction of that ! You don't have to take their insurance.

 

Get some quotes off the internet and see how much you can get the same cover for.

Dear Stefaniex

 

I would get advice as soon as possible my partner and I have just been repossessed by these b------rds. They will go to any lengths to do this our arrears were £6000 we went to court two years ago and had an agreement to pay the contractual payment plus £200 off the arrears. After the two years were up we still owed the same amount and they then added more charges on. We then were took back to court and had a Judge that was from the dinosaur era who said that because my partner was self employed and we were in negative equity that he wouldnt accept the application. So we were out on our ear had to move within a week. So although they are a lot of happy endings on here there are also unhappy ones dont bury your head in the sand.

hi all ... i cant find my last thread .. last week i recieved a letter from capstone threatening to get an eviction date .... after speaking to their solicitors they told me that the eviction date would most likely be at the end of november and urged me to contact capstone to make payment arrangements ,i said i would do this at the end of the month when i had the funds to clear the missed payments under the court order .

yesterday i recieved a letter from solicitors stating the eviction will be on the 9 nov . .. i can bring payments up to date by the 5 nov but not sure if i should liase with capstone again or submit an n244

any help please x(ps the letter was adressed to present occupier)

Hi Stephanie, sorry to hear you're in this situation again with them. If you're sure you can make the missed payments by 5th November then you should write to them by recorded delivery or registered advising them of this. Then ring them a few days later to get their decision. In the meantime we can start an N244 application in case they refuse to accept your proposal, as you will no doubt be making a normal payment at the end of October, we can wait till you have made that before submitting the N244. Let me know if you need help with the letter.

thanks for the reply ellen... will it not be to late to wait until the 5 nov to get in touch or make an application for the n244 i will be making a payment on the 26 october for 2400 missed payments and make octobers payment on 5 nov a letter to send them would be great ....... should i wait until i have made the payment of 2400 then send the letter...... wat do you think the chances are if i make up all missed payments under the court order? i will still owe the nov payment wen the eviction is due to take place

You don't wait till 5th November to send the letter, send it tomorrow telling them what payments you will be making and when. If they don't accept, then we can put in the N244 application as soon as you have made the payment on 26th October so we can include the proof of that payment and also a copy of the letter you sent.

 

What was the reason for missing the payments? Also, did you do anything about the buildings insurance they charged you for?

yes sorted out the insurance ......i sent them a letter on the 6 saying id make up the payments 1000 on the 8 oct 1000 on the 15 and balance at the end .... but because they had sent a sploicitors letter wich croossed with that i didnt know wat to do and didnt make payments thought it best to pay a lump sum

Are you still in a position to pay £2000 ? if so, you should do so as soon as possible it will help your case enormously if we have to enter a N244

yes i should be able to pay 2000 by the end of the week but will still owe 400 plus octobers payment ..... do you think they are likely to cancel the eviction if my payments are up to date under the court order?

How will you be making the payment? if it is by debit card over the phone, you could ask them to accept your proposal at the same time ?

ill be making the payment by check and would prefer not to speak to them on the phone as they tend to try and get me to offer things i cant afford .......but would we have time to do it in writing ...how soon b4 the eviction date do we need to submit the n244 x

OK, you should send the letter with the cheque, but take a photocopy of the cheque before sending and remember to write your name and account number on the back of the cheque so there's no chance of it not being applied to your account.

 

Ideally you should submit the N244 a week before the eviction date which I think would be 29th October - also, you will have made another payment on 26th ? You've said you can make a further payment at beginning of november so you'd be able to take proof of that to the hearing.

yes i plan to have payments apart from the november payment up to date by the 4 nov .. any chance of some help with the letter ?

although payments have always been somewat eratic it was only when the machine at our dry cleaners broke down .. we couldnt work for a week and then a month later after paying out 1300 pounds ... the mechanics had not fixed it properly and we had to wait for them to get a part from another country and was out of work for another 10 days ..... the part that went on the machine was a 1000to 1 breakdown and not something that usually breaks . just our luck .. i have receipts from the engineers if that would help

hi just a quick update . got a call early this morning from capstone to discuss arrears and pending eviction ,the lady was really nice and asked why we had fallen behind and said she understood .. we went through another budget sheet and i told her that i still wanted to pay the 300 per month as the court order stated .. she asked me if we colkd pay a lump sum b4 the eviction date and i said i would pay 4,000 before the 5 nov .. she has now passed this over to someone else and we will hear from them in 48 hrs if they agree ... Ellen should i still send the letter?
