hi, many thanx 2 this site and members on it for helping me try claim back my charges from the halifax so far :D wouldn't of bothered if it wasn't for you guys and gals :)

 

anyway i'm stuck and im hoping you can help me out...

the Halifax recently wrote back to me saying I knew the situation when I opened my account, blah blah blah blah.. I'm presuming they say this to alot of people to try and put them off claiming... but I'm confused on which letter I reply to them... I have read it on this forum before, but can't find it now :(

it did start off as...

 

'I write in response to your letter refusing for a refund of bank charges.'

 

I hope you can help :)

thanks alot for your help...

 

the 1st bit says

 

'I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].'

 

they did actually respond to me, just not in the way i would of liked!!

 

also, does this part of the letter 'I am enclosing a copy of the schedule of the charges which I am claiming' mean i just send them the copy of charges again (the spreadsheet) ?

 

and would you suggest i take out...

 

'Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department.' ?

hi its okay and your not a pain its better to ask then get it wrong yes send schedule of charges

and attach to your letter the paragragh is optional but dont add if you dont intend to go through with it have a read around some of the threads they can be helpful and have a look in these

thankyou very much. it just confused me which letter to send to them now.. as letter 3 (letter before action) starts off with ''I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].' so i didn't think this would be the correct letter.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

Im sure youll soon come out a winner and it really doesnt matter how much your claiming back.

Weve got to show the banks that we wont be fobbed off any more and the more people put claims in the better.

Its about time the "little people" had thier say.

We are known for our "stiff upper lip" attitude" but some times its important to step up to the plate.
