there's a big court case today OFT vs Banks... if the banks win, does this mean we can't get back our charges? will it be a quick decision or will we be waiting weeks to hear the outcome?

  19. thankyou very much. it just confused me which letter to send to them now.. as letter 3 (letter before action) starts off with ''I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].' so i didn't think this would be the correct letter. Thanks for your help tilly
  20. all this is soooooo confusing lol i have recently been sent my statements from capital one, so I'm in the middle of browsing as we speak... I have been charged £12.00 per charge on 'overlimit fee charged' 'late payment fee charged' 'returned cheque fee' are these the charges I can claim back? Also, I've been charged a hell of alot of interest monthly (which I knew about anyway because it wasn't a 0% credit card) but can I claim back any of that back aswell? I've also read a few threads on here and read people claiming back 'contractual interest'... can some-body explain to me what this is please:confused: thankyou muchly
  21. thanks alot for your help... the 1st bit says 'I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].' they did actually respond to me, just not in the way i would of liked!! also, does this part of the letter 'I am enclosing a copy of the schedule of the charges which I am claiming' mean i just send them the copy of charges again (the spreadsheet) ? and would you suggest i take out... 'Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department.' ? sorry 2 be a pain lol
  22. hi, many thanx 2 this site and members on it for helping me try claim back my charges from the halifax so far wouldn't of bothered if it wasn't for you guys and gals anyway i'm stuck and im hoping you can help me out... the Halifax recently wrote back to me saying I knew the situation when I opened my account, blah blah blah blah.. I'm presuming they say this to alot of people to try and put them off claiming... but I'm confused on which letter I reply to them... I have read it on this forum before, but can't find it now it did start off as... 'I write in response to your letter refusing for a refund of bank charges.' I hope you can help Thanks
