Hi MTM but if you look above the top link in my signature, you will see that I had over £400 in total refunded from Abbey-WITH 1 PHONECALL!

 

I totally understand where you're coming from though, and that it doesn't happen very often, but if someone wants to ring the bank on the offchance that they might get a bit of info, well I wouldn't tell them not to. JMO

And when I did ring, it was before I had even heard of this site.

In no way did I believe what they were telling me on the phone either ie that they couldn't give me it back.

I had only actually rung them because they'd taken over £100 in 1 month. I told them they could give me it back and that they would, and after a lengthy call with much pushing and persuasion from me, plus a big sob story, they refunded the amount taken. They processed it as a complaint and about 8 weeks later I got back everything else they'd ever taken.

Nice surprise for me!

I'm very aware that Abbey have dealt with Claimants differently than what the Nationwide does.

One of the original differences was Abbey quoting that Claimants S.A.R. details were on Microfiche + were therefore NOT subject to the Data Protection Act.

This AGAIN was a tactic used by a Bank to deliberately thwart Claimants + was proved to be TOTAL B*LL*CKS also!

 

Nationwide have NEVER offered to Settle a Claim BEFORE the Claimant has had to File @ Court or the FSO has been involved.

 

If my memory serves me rightly, there has even been documented occasions when Claimants have been told at the last minute via a phone call, that FULL payment has been/will shortly be made + the Bank Employee to advise the Claimant to immediately inform the Court of this to stop the Claim.

...Only for the money NOT to materialise/be well short of what was Claimed and for the Claimant NOT to be able to re-start their Claim!!!...:eek:

 

Am not quite sure where I saw those Threads many moons ago, but they are certainly out there somewhere!...:confused:

Hi MTM. I didn't mean that I suggested that he ring to try and get a refund like I got, just a bit of info! Yes he was fobbed off but sometimes one of the best ways to learn is through your own mistakes-not other peoples.

I understand about bankers ringing to say a full refund would be made, then it doesn't happen, but common sense would tell you not to withdraw your claim until the money is in your hands really.

 

I think we should agree to disagree on this one.

In my original reply in post 12 I did state that I didn't know how much good ringing them would do, but he rang, got fobbed off and that was the end of that. If anything good has come out of it, he's learnt a valuable lesson in how not to rely on or trust the banks at all.

In a simple case as your was monopoly23, that would not necessarily be the case.

For Claimants who think that they may have unlawful Penalty Charges spanning many years, it would be a very foolish Claimant indeed, who believed what figure a Bank Employee came up with, without checking it out for themself 1st!

Of course. My charges had only been applied in the last year. I am in the middle of three claims for various people at the mo and I haven't bothered ringing any banks. Even with online bank statements, I still send off the SAR to see what they come up with, and how untrustworthy they actually are.

Phoning them is a bit of fun really in my eyes. You can tell by their silence when you start quoting DP laws that they can't believe their ears. Most of them don't have the foggiest idea what you're talking about!

Just to clarify, I actually do have all my statements which show my charges but I do not have the years statements from when I first opened my account. Although I am certain that there will be no charges applied on them because I did actually keep my account in order in the good old days!! I wanted these just to be sure that my figures were correct before I sent my letter requesting a refund. Didn,t want to miss the odd one that I might not be aware of!!!!

Hi speedy016!

The paragraph that U have quoted in your last post is referring to 'believing a figure that a Bank Employee had come up with during a telephone conversation'.

If U already have your Bank Statements for the period that U believe that unlawful Penalty Charges + any Interest pertaining to them were debited from your Flexaccount, then U can dispense with even sending a S.A.R. off to Nationwide + proceed straight to sending them your Preliminary Letter!

Due to unpaid automated debits and charges being incurred on your account, all direct debits and standing orders have been cancelled to prevent further charges.

 

Please contact the relevant companies to cancel them on their system which may take up to 10 working days. Failure to do this may result in the company continuing to claim for payment and further charges being incurred.

 

It is important that you make alternative arrangements for payment immediately.

 

Please bring your account within the agreed overdraft limit. If you are unable to do so please call us on 0845 600 5707 option 2.

 

 

This is the ONLY letter ever received by NW in relation to going overdrawn, they usually just decline all payments and take us into the unauthorised overdraft with their charges and interest. I have to admit this is the worst amount we have ever been overdrawn but that is purely down to NWs inflated charges and interest. No DDs have ever been paid which take us into the OD. IT IS ALL MADE UP OF CHARGES. This all started when we were one pound short on a DD that was due! Since then the charges have spiralled and we are now in this position.

 

Why do we have to pay the charges immediately when the charges shouldn't be on there in the first place.

 

Any help on this would be appreciated as I am not sure how to reply.

 

I must admit I have been expecting their dirty tactics but didn't think they would start until we had actually requested formally that we wanted a refund. We haven't even received any info from the S.A.R. yet.

U HAVE to pay the Penalty Charges cos Nationwide control your Flexaccount!

Now would be a very good time to have your wages/benefits paid into your 'parachute' current account + transfer ALL your DD's etc to your NEW account.

Any debits that Nationwide deduct from your Flexaccount will be re-imbursed when they pay your Refund into your Flexaccount......eventually!!!

I have already set up a parachute account and I phoned my hubby at work and he has changed bank details today, I have already started changing DDs over but most of them are saying the bank haven't give me enough notice therefore the DDs that are due out within the next 10 days will not be collected as there is not enough time for them to set the new DDs up.

Thats okay tho I will just write them a cheque to keep us upto date with the bills.

 

I had an accident at work and am currently off sick but I do not get paid in full just get SSP which goes into the nationwide, would I be better off leaving that as it would help pay off the OD or shall I just change it and pay it off on hubbys payday. :evil:

 

What a set of W*****S they know that my hubbys wages would be going in to clear there extortionate charges but they are just being awkard.

Ideally, it is better to have a positive balance when starting to Re-claiming process, as it takes away any leverage that a Bank has to put the Claimant under duress with threats etc.

 

Unfortunately, for some Claimants this is NOT always possible due to personal circumstances.

 

If money is tight, U are advised to transfer any incoming wages/benefits to your 'parachute' current account + also your DD's + SO's etc.

 

This stops large chunks of your income being immediately swallowed up by the ever increasing unlawful Penalty Charges + O/D repayment plan that the Bank may insist that U adhere to.

 

Any O/D + further unlawful Penalty Charges will be paid off soon enough, when the Bank refunds U, due to your ongoing Claim being Settled in Full.

 

There is ALSO the Right of Appropriation...

...But this MAY be ignored by the Bank in the short-term + so leaving U with still not enough money to realistically live on, until your Claim is Settled in Full, depending on your personal circumstances!
