there are loads of people I know who were waiting for me to complete my journey, and now hopefully they will also get back all the money they have had removed from accounts.

If you are reading this and have not claimed yet, I hope this encourages you to do so! :D

If your claim has just started, take heart, it will be ok in the end. :D

Well done Crusher,

 

I sent my initial letter to HSBC yesterday and your story continues to inspire me and strengthens my resolve.

 

The last straw for me was when they gave me a 'goodwill' payment of £25 in respect of a complaint I made about the HSBC call centre a few months ago. On the same day that they paid me they took out a £30 penalty for being overdrawn by a couple of quid.

 

All my working life (30 years) I have been a blindly loyal Midland/HSBC customer and now I have realised that my past few years of financial struggling where my bank had offered a 'sympathetic' ear was merely a distraction while they continued to help themselves from my account. I'm now back in the black for the first time in years, no thanks to HSBC. I'm back on my feet and out for revenge. Its time for PAYBACK!!!

Well, as my learned pal Gordon, I have received this letter this morning

 

Dear Crusher,

 

Thank you for returning the signed settlement letter.

 

We confirm the agreed sum will be credited in the next day or so. If the credit does not appear within the next week please telephone the write and we will chase the Bank.

If you have been asked to sign away your rights, can I suggest you do not- you are taking the bank to court, not the other way around, hence you call the shots, you are in control.

Now get this!

 

I have just checked on my online banking, no cash as yet, BUT recent "card misuse" fees and the £75 I was due to be charged next month have dissapeared, without me asking!!!

 

Has this happened to anyone else? How about you Gordon?

Its not happened to me, but I've been a good boy for the past 4 months or more, and hopefully intend to stay that way. I'm still using the overdraft, but not exceeding it. Hopefully even that issue will sort itself out over the enxt few months.

 

So, well done crusher, seems like they are finally listening to us!

The money is in the bank this morning.

The whole process has been going since mid may, so an idea on how long the process takes if it goes as far as MCOL (small claims court), about 6 weeks from requesting statements to actually receiving the cold hard cash.

 

Will be making a donation for sure, if it wasn't for this site it is unlikely that I would have got the refund of unlawful bank charges.

I'm an HSBC customer, and first heard of this process this weekend.

 

From what I've read, the charges apply to customers who have overdraft accounts.

 

I don't have an overdraft (the bank won't let me have one), but I have had repeated fines of £25, totalling £125, for the same reasons as everyone else.

 

when i asked the bank why i wasn't allowed an overdraft, but able to continue to withdraw money that i didn't have, they said it was because they didn't want to see me 'stranded.'

 

i'm changing banks anyway, but i want to pursue a claim, if i have one.

Hello Simon, and welcome.

 

I am on my hols currently, so lucky you caught me in!

It matters not whether you have an overdraft, whether the account is open or closed, you can reclaim any unfair charges levied upon you.

Have a look at the faq and read around the threads and digest what you read so you have a really good idea of how this all works.

Start a new thread (link at top) in the HSBC section (where we are now) and title it something like Simon V HSBC (or something witty if you can!) and go from there.
