So i have been reading through the forum and it seems to be a fairly discussed thing, so thought i would start a new thread for any help, guidence others can show.

I sent a parcel, (from ebay through packlink with EVRI, not insured). On the 16th of may it was sent and tracking just shows following:

We're expecting it
12:21 - Tue May 16
We're expecting your parcel to arrive with us soon and we'll update your tracking once we've received it
We've got it
12:55 - Tue May 16
We've received your parcel at the ParcelShop and will be collecting it shortly
 
The account i sold it on was my mothers so at first i sent a email from both of us. I am now thinking ill just restart with it direct from my mother and she is happy to do court/mediation etc. I will post the letter below for any changes before i resend it. Also does anyone have any actual email addresses for evri, should i sent one recorded delivered to an address?
 

LETTER OF CLAIM

Parcel reference number ***************

Dear Sir/Madam,
 

On 16/05/2023 I used your service to send a parcel under the above reference number. 

The package never arrived at the destination and I am assuming that it has been stolen.

The label was purchased via a 3rd party (eBay Packlink) but I am pursuing yourselves as I am entitled to do under the (Contracts (Rights of Third Parties Act ) 1999).

 

Value of sold item = £165

Packlink compensation =  £25 (standard compensation)

Total loss to me (amount of claim) = £140

 

You have so far declined to respond or reimburse me and I am therefore informing you that I'm proposing to begin a county court claim against you within 14 days and without any further notice unless you reimburse me in full before that date.

What was the item? Was it properly declared?

Was the value of the item properly declared?

I'm a bit confused about who sent the item. Who was the customer?

Item was a Graphics Card, I  believe it was declared, i dont think you get an option to change it through packlink/ebay

Again the value is auto put in by ebay.

For all purposes my mother, she sold the card, her account, she bought the label etc.

Okay thanks. Have you done a thorough reading of the EVRi cases on the sub- forum?

Are you aware of the two arguments that they are likely to produce in order to justify their withholding of the money and to defeat your claim?

What are those arguments? (This is a test)

Yes i have read some, not all mind.

1, being i didnt pay for the insurance, 2, being that it was "bought through a third party, packlink" so i have to take it up with them. Already had that response! Ill have another look through incase ive missed something, just wanted to reply quick to show i had already read things.

Yes, send the letter.
You will probably have read enough here to understand that it will make no difference that you are simply fulfilling the requirements of the pre-action protocol to give them 14 days.

Register with the MoneyClaim website. Start preparing your case and put up the particulars of claim here before you click them off

Brill thanks, Yeah ive seen the exact threats and responces they send to each person.

Ill start registering with mcol now.

Is posting a letter sufficient aslong as its tracked, trying to contact them through email is near impossible. Someone posted a postal address on here ill have a look for.

Yes, post is fine – but a copy by email would be a good idea as well.

Emails are very difficult. They seem to change their email address and also their telephone numbers any time they start to become well known.

This company seems to specialise in liability evasion
