Hi all.

I'm helping a family member who has been diagnosed with Dementia and Alzheimer's. Going through his Bank Statements, he's been paying £20 a month to Superdrug Mobile even though he hasn't used them. he's been paying it for a long time. They must have seen him coming and sold him the deal in store.

 

I'm trying to get them to refund him something to no avail.

 

Does he stand a chance legally?

 

He's 82 and can't even remember doing it.

 

As far as I can tell, it is a SIM only contract that could have been cancelled at anytime.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

Does "he's been paying it for a long time." mean that when he took out the contract he hadn't been diagnosed with Dementia and Alzheimer's so Superdrug Mobile would have no reason to believe he had a disability or was a vulnerable person?

 

It's hard to see what grounds you would have to cancel the contract retrospectively, but let's see what others here think.

 

Have you cancelled the contract now?

I have no idea how long he's been paying for it just yet.

They won't release that information to me.

They won't cancel it either. 

 

He's been on a Tesco Mobile contract for a number of years now, and that is the only one he uses.

 

He's only been diagnosed with Dementia and Alzheimer's about 8 months ago, but his memory has been bad for a number of years.

 

Superdrug want Account Number etc, but I can't find that information.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

go do a dd guarantee reclaim to his bank. for every payment.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
