If the case was brought before a UK civil court would UK rules apply or foreign rules?

 

I wonder if the original contract would strate what jurisdiction it's terms would be decided by?

 

I note that UK contracts frequently have a clause that says in so many words that any disputes  will be interpreted under UK law.

Yes owners of the debt can issue a UK court claim if you reside in the UK, subject to UK court procedures, so can defend the claim. 

 

The bit that confuses people is that the debt was created under UAE law. But when they try to enforce using a UK court, if you defend the claim, they will look at the claim and your defence, ensuring any UK court rules are applied. So if you disputed the debt, the claimant would have to provide evidence to counter your defence argument.

Morning, I have started receiving letters/emails/texts from IDR with regards to a loan I had with Emirates Bank.

 

I left Dubai in 2009 and the money they say I owe is now less than before!??

I have been receiving letters on and off for years.

 

I am now living with my partner who knows nothing of this as I have been advised to ignore it in the past so I have.

 

I thought after 10 years it would stop.

They are now threatening CCJ and removing the money from my salary etc?? 

 

Should I keep ignoring?

Will this affect my partner (he owns his own house but my name is on nothing).

I think I know the answers but need reassuring.

Of course don’t reply! They send me the same stuff...they could never touch your partners assets as the debt is not his!

 

Just keep ignoring and soon it will be statute barred (10 years credit cards, 15 years loan).

 

After that they can ask for payment but can’t actually pursue it in court.

Don’t put your name on the house until 15 years has passed

i've re opened your old thread and moved the posts you made today to it.

correct.

 

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

WOW These guys are insane and crazy to see they are still going. I’ve not heard from Mr Coyle and his bandits for a few years now. I wonder when they will pop up again with there threatening letters etc. 
 

ive been in touch with the banks by email always and saved in folders to keep track. This is my suggestion and same as me I am not on any mortgage and don’t own anything or have savings.

So you ignored them for a bout a year and they have only just got back to you? did they contact you in the interim and have you ever replied? I'm in the same boat
