Lowells and disputed o2 'debt'

I have taken a new job and in an area where O2 have no service.

Contacted O2 for advice to be told my phone was out of contract and I was told this on three separate occasions.

 

Based on that I looked for a supplier who covered the area,

found one signed up for a contract with them and contacted O2 for a PAC code

 

 

at this point I was told I still had a year left on the contract,

I mentioned my previous conversations to be told they made a mistake

I have now been sent a termination invoice.

 

I am reluctant to pay this as I went to another supplier based on the fact they told me my contract had expired

and if they made the mistake why should I pay for that.

 

 

Is there an O2 rep here?

Firstly, where did you get your new contract?

Over the phone/internet or in a shop? (i'm just thinking of DSR which gives 7 working days to cancel the new contract in case you cannot break from O2).

 

As for whether you were out of contract or not,

can you remember when you took out the contract and if it was 18 month or 24 month?

Welcome to CAG

 

Write a Formal Letter of Complaint, mark it as such. Explain what's happen (informed that there was no contract in place for the third time - you did everuything you had to), how they have let you down (provided mis-information three times, now stating you have a contract) and what you want them to do (cancel the contract). Explain that if the matter is not resolved then you will take the matter further.

I had an O2 account rang up about the poor reception where I was working and was told my phone was out of contract,

 

I looked for another supplier found one, and rang O2 again to confirm my contract had expired and they said it definitely had.

 

A few days later signed up for a new contract with a new supplier, rang O2 to get my PUK code to be told that my contract had in fact not expired and the people who told me the contract had expired had made a mistake, by then it was too late.

 

O2 sent me a bill for the "remaining contract" value and they will not accept my argument that due to them telling me the contract had expired that is why I took out a contract with a different supplier.

 

I have made a SAR and have the recordings of the calls where they told me my contract had expired.

 

This has now been passed to a collection agency, what are my options?

If you have a transcript/recording of the call where you were advised the contract had definitely ended and you based your decision to move provider, on that information, then I think you should perhaps be looking to making a formal complaint to their Head/registered office to get them to change their minds.

 

You need to check your credit files as well.. Mobile phone providers are only too happy to trash those for a few £'s !

let them goto court

ignore anything other than a claimform.

 

 

the judge will laugh them out the door should they ne so stupid

have you received their notice of assignment

 

 

or didn't you advise o2 of your new address.

 

 

or have o2 sent you letters to your new address previously.

This is the curious thing, O2 have my current address but the notice of assignment and Lowells letter stating they now have the account were in the same envelope but was posted to an address I left 10 years ago, it was passed on to nme as I know the people there.

 

O2 deny ever sending to that address but I have a letter of assignment from O2 addressed to the old address (this adrees has never been given to O2) and Lowell still can not answer why, it is all very strange.

 

I am a contractor working in the finance industry and am very cautious regarding my credit file and want to ensure I do not get a default on my credit file as this could impact my ability to gain employment how do I stop Lowell doing this?

only the original 'creditor' can default your file.

just had another contact from Lowell basically saying the same thing so everything I say seems to be ignored.

 

I have told them I am bored with the repetetive contact from them and have asked they either cease activity and confirm the account is closed or take me to court and lets have a decision there.
