I wonder if anyone could give me some guidance.........

A relative has been involved in an accident while using the vehicle for 'social, domestic or pleasure'. Following the accident they have studied the policy and noticed that it did not cover business use which the last policy did as they use the car for minor diy jobs. Having used the car for business during the current policy, but was using it for pleasure on the day of the accident, is the policy void?

If the insurance company was told the vehicle was used for business previously are they likely to void the policy?

 

Having read various websites, it looks like they have unwittingly committed insurance fraud. Where does leave them?

 

Any help would be gratefully received as my elderly relative is going crazy with guilt and wants to tell the insurance company that the car was used for business during the year even though not on the day of the accident.

If they are using the car to go to customers houses to do work for them and carrying work tools, then yes they should have declared this.

 

Obviously they should declare this, but the Insurers are not going to say thank you very much for your honesty, don't worry about the claim and you just have to pay the extra premium. No the Insurers may say they would not have issued the policy, they will cancel the policy and not pay for damage to the car. They may also pursue your relative for any amount paid to the third party. There is then the problem of having had a policy cancelled and having to pay higher premiums.

 

It might therefore be wise to say thank god it was not being used for work on the day of the accident and to not mention it at the moment. Then don't use the car for work and when the policy is next due for renewal to get quotes based on using the car for work.
