I went over to Ashton Moss on Saturday night, it was about 8pm, pitch black and hailstoning.

 

Due to works being carried out, a big chunk of the car park was closed off

I parked on a road which goes around (but within the perimeter) of the car park.

 

This road did not contain single or yellow lines,

there wasnt any marked bays along this stretch,

i thought I was ok to park here,

as did all the other people along there too.

 

 

On returning to my car, I find a ticket has been served to me for

"Not parked correctly within the markings of the bay or space".

 

maybe i shouldnt have parked on the road,

yes there was a sign but i didnt see it until i returned this morning to look,

(it was dark and hammering down on Saturday night)

and as the carpark layout had changed,

i was stressed as it was and as there were no yellow lines,

presumed I was ok to park there,

 

 

can i refuse to pay the fine as the reason i was given it, isnt correct,

 

 

there was no bay or space markings for me to not park correctly.

 

 

Can i appeal on these grounds or will they just change the reason for the ticket

Do nothing for now apart from read up on this industry.

in answer to can they do this it will depend on the wording on the signage at the site as to what constitutes a breach of the contractual conditions.

 

 

In law, everything that is not prohibited is permitted which means they have to say on the sign that you cannot park there,

it is not good enough to say that the vehicle was not correctly parked without proof of the definition of what is correct.

 

However, that is an argument for the future.

 

 

For the moment Just wait for a notice to keeper to arrive on your doormat.

 

 

This must arrive between 29 and 56 days after the day of the alleged event so a while yet.

 

 

The reason for waiting is to make ANPR spend their money chasing the keeper,

who has less legal obligations than the driver and many parking Co's get the procedures wrong,

killing any claim.

 

 

i wouildnt bother responding to their ticket yet as that will identify you as the driver and make their job a bit easier and cheaper.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
