We have 2 cars on hp, but one we want to hand back, as we have Been granted high rate mobility, we have paid 50% of the contract, but want to know if it will effect the other car contract as with same company..

 

I do not see anything in the contract telling me otherwise.

no shouldn't at all

clearly write stating you wish to exercise the Voluntary Termination right under the agreement.

 

 

if the car is in good nick

yu should have nothing more to pay.

 

 

they CANNOT charge you for collection.

VOLUNTARY TERMINATION OF AGREEMENT UNDER s99 CCA 1974

I am writing to notify you that I am exercising my right to terminate the above Agreement under Section 99 of the consumer credit Act 1974.

 

 

You will understand that the aforementioned section permits the debtor to terminate the agreement at any time before the last payment is due.

 

 

There is no restriction regarding the exercising this statutory right,

particularly none in respect of any perceived arrears or monies due on termination

 

I understand that I shall be liable to you for the amount calculated under the formula in Section 100 of the Consumer Credit Act 1974.

 

 

As I have paid more than the amount calculated under the formula in Section 100 the amount due is zero.

 

The above agreement will be terminated 14 days from the date of this notice.

 

Please send me details of how the vehicle can be returned to you.

 

You will be aware that statute prevents you from levying a charge for the recovery of this vehicle;

guidelines also state that if you require me to deliver this vehicle it must be no more than a short (reasonable distance) from my registered address.

 

Please confirm receipt of this request by telephone/email within 7 days of receipt (my number / email address).

They phone today, with no date for collection just told when there team in area,

 

 

I've told them this time next week it will not be insured and not registered to me so must collect as will be on road,( have no drive way)

 

 

they were not impressed but I'm wondering if I'm ok to do this or I have to re tax it and another months insurance

Called insurance to see about partners car going on that as his 8 year no claims is on this car, so thought we would cancel his and put his car on this one, they refused it! Aghhhh I want to cry as it only 3 months till it up for renewal we will lose the years ncb.
