Frankly , in my opinion I would wait it out . However depending on what money you have available and the amount outstanding you could make a full and final offer of say 25% .

 

You can always make an offer or set up a plan if they send you a LBA

 

I have a bit of a grudge against this company so maybe someone else can give a more measured answer

Any opinion I give is from personal experience .

What i meant by the template is the Fraud / Verification Notice... Allen got one recently and i had 4 turn up on my doorstep nearly 8 months ago... Which have nothing to do with me.

Im not referring to the application process :) More MMFs documents.

 

They have sent a NOA and details of the Bank Account that it was "Paid" into...

 

Ok, sent the prove it letter and got a response from them today. They have provided a formal notice of assignment and then a separate letter stating the amount borrowed, when and which account it was deposited into. They have called it a VERIFICATION/FRAUD NOTICE. Is this sufficient? I thought this money had been paid back but have been through my bank accounts and can find nothing to indicate this is so. Incidentally, it wouldn't be statute barred until next Feb.

 

Always when dealing with any DCA doing the usual "Checking if its mine", always have a little bit saying "I Do Not Acknowledge This Debt!"

 

A F+F Settlement means you WILL Reset the SB clock... So think wisely....

Also in IMHO , i would hold off for now regarding responding etc, I personally would wait it out... But people will disagree with me.

Is this on your credit PRofile at present~?

What's an LBA?

LETTER BEFORE ACTION:

 

 

Lays down the requirements to be fulfilled to prevent legal action from being taken, usually has a 14 day time scale attached.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'd love to think it's because they've paid peanuts and could not/would not ever take it any further - something is better than nothing. However, their paperwork does seem in order :(

 

If I was going to make an offer, what is the recommended percentage? (I'm not at this stage, I just wondered what the norm is)

It probabl;y is because they paid peanuts for it and can make a quick buck

 

You can tie them up with complaints, ask for the Deed of assignment quoting Van Lynn Developements v Pelias Construction and also Webster v Ridgeway [2009] . I know it is FMOTL rubbish but you are entitled to see it . Also have a good read of CONC 7 http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?424-Conc-7-Arrears-default-and-recovery-(including-repossessions)-(CONC-7)

 

Just remember that as far as I know no one has yet taken court action using it but it is worth using it. If they have not complied then you can make a complaint to FOS which will take weeks to sort out

The idea is always start low , you can always increase. If you word the letter very carefully can you still do it without resetting the SB clock. You can make out that although you deny any liability it is causing you stress so to make it go away you will offer £x

Indeed you can make an F&F settlement without any problems just use the DCAs "get out clause"

 

 

"This offer is made a gesture of good will with out any admission of liability now or in the future".

Do P2P have an in-house dca? I feel so convinced this was paid at the time (although a little late) that maybe I paid it to a different source? I've been searching under p2p on my bank statements but maybe I shouldn't be. Do they have a particular company they use? I know I should have the paperwork but it was 5 years ago and the fact that I haven't kept the paperwork is because I believed it was all sorted at the time.

I doubt it's in the library which has generalised "templates" making such offers one has to "tailor make " them.

No, youd need to draft something yourself to really communicate your F+F offer etc... Be warned that MMF tend to reject F+F from what ive seen historically, unless its on their terms,

Just reading your terms from earlier... You blacked out all the amounts on the list... However in the T&Cs it mentions a default fee of £59?!?!?!?!?!?!?!

Thats reclaimable i believe...

 

Theres a reason they would be discounting it if they have offered that...
