  1. I think we need to remember that many people believe they are morally tied to repaying the debt and many DMP providers reinforce this belief. People make many choices and I would rather not victim blame or make people feel any worse than they probably do already. I think a cca request was sent to argos- see post 58 What is important is that each account is looked at and a plan of action brought together. Personally I would stop paying Argos, I bet if you sent a S78 request now they would recon it but at the wrong address, for example you current one rather than where you lived when you took it out. I know after my ex died, I asked for proof of debt and they sent back current address and not our matrimonial one where they lived when the card was taken out. There are tried and tested ways and means of checking if debts are enforceable - also remember, sometimes when debts are sold on they are done so with provision that the new owner can not get the original paperwork or even they can not litigate. Doesn’t stop them trying. I had two RBS credit cards with enforceable credit agreements which when sold to Cabot, were written off.
  2. I think I have written about my disputes with VM. They closed my account without explanation followed by both my credit cards. The account closure is currently with the Ombudsman after the investigator did not uphold my complaint. Anyway- on the credit card section of both credit karma and clear score I am showing as pre approved for VM credit cards. Now you might think, why the hell would I want to be involved with such a rubbish company but a back up travel credit card would be useful - I have a metro bank one but it failed on my last holiday in Europe and I had to use my debit card. Does pre approved 100% likely mean I will get a card or will it then show as a rejection and mess up my credit score?
  3. The question is- when I try to claim compensation off BT what is an acceptable hourly rate for my time? Long story but Mum was due to move, set up move but then sale fell through. Told BT to cancel (they said it had already been cancelled) however on 28th (date of original move) BB went off at midnight then 24 hours later landline went off. Was lied to many times but finally got a new account set up and phone went live on Sunday night evening. Router being delivered today with a date of 16th for going live but today received a text saying as BB was now live (it isn't) they were turning off mini hub. I have spent hours on the phone and have kept notes BT are a nightmare Thanks
  4. I have also found Metro to be reasonably good- they also do a credit card . They are branch based so it depends where you live. One of the great benefits about Starling and Metro is that they do fee free transactions in the EEA. I know holidays maybe unlikely in the near future but its good to know about.
  5. Ten years ago my ex died and I cleared her estate. After funeral costs, headstones and our expenses (clearing the house) I wrote and told her creditors there was no money left. They all accepted it although a couple did send it to a team who deal with estates- but a copy of the DC and they all went quietly away.
  6. Hi Yesterday I received a text from OPOS with an amazing offer of a 75% discount - however the last communication I had with them in writing was in May 2015 and one accidental call in June 2016. I don't answer my phone at home- in fact I am rarely there but will have a quick look for possible calls next time I'm home. I thought this was long ago a Norwegian Blue- I even accessed an old email address and they have not been in communication I guess its an ignore
  7. Thanks- that has pointed me in the right direction. I don't think it's Virgin Money Personal Financial Services as that appears to be the insurance arm of the business , but as I say in the right direction.

  9. Thank you of the heads up but casual readers will not be able to identify me from my usernames. Different places give different perspectives, to be honest, some can be quite judgemental some less so. I appreciate I will probably get nowhere but I would like an explanation if only so that, if they have found my actions suspicious, I can refrain from doing it again. If Virgin money had told me they had also changed the terms of my current account so there were no non sterling transaction fees, I would probably have been fine. It's not spending on credit that is important, it's avoiding fees and lining the pockets of the banks that is. I have been under considerable stress and anxiety relatively recently and this has been quite triggering. The irony being I am in a more stable financial and personal situation than I have been my entire adult life - I feel more affluent (remember affluence is relative ) than I ever have.

When I say pay I mean it figuratively, however, the change in terms and conditions of the credit card will have some real life costs to me- it was the card I use when we go on holiday which is often outside the eurozone. Our countries of choice are usually Poland, Croatia and the Czech republic and prior to the war, Kyiv. I am indeed wondering if the movement of money has flagged something but there are really straightforward answers if only they asked. If that is the reason then fair enough and lesson learned , by the way it was not mega bucks, the maximum cash deposit was £1300. I had also been paying the ground rent for my partner for 10 months and then deposited a cheque for 10 months ground rent. When we go away , I like to have some money in different accounts incase any do not work where we are going, but I am not affluent enough to be able to have it sitting there when we get back. I have checked an up to date version of my credit file and there are no cifas markers.
  11. I am at a loss. Last week I received a letter from Virgin Money saying they are closing my account in 60 days but no explanation. I called and was told to go into branch so I travelled 25 miles to the branch to be told it was nothing to do with them. Bit of background I opened a Yorkshire bank account in 2014 as my town had a branch (long since closed) A little while later I opened a Yorkshire bank credit card with a small credit limit More recently I opened a B credit card as it had zero non sterling transaction fees , this was just before they closed that type of card to new applicants. So Virgin money come along and transfer all my accounts to virgin money. I opened another virgin credit card with 12 months 0% as I had drowned my old iPad and wanted a new one. Almost two months ago I found out by looking at my statement that the B credit card had changed its terms and conditions and now was only zero non sterling if the transaction was in euro's Swedish Kr and Romanian Lee. I called and queried this to be told it was a commercial decision but the call handler did acknowledge that I had not been told about this. I made a complaint - to be honest this was the reason for keeping the card open . They have about another 3 weeks before the 8 weeks are up and I take it to the FOS Anyway, after getting the letter giving me 60 days I made a complaint that they a) sent me round the houses b) were unable to tell me why. I was told I would get a call back within 4 days After 7 I called to be told the complaint had been closed as it had no standing and that the reason my account was closed was something really serious and someone would call me before the end of the 60 days. Just to confirm, I usually keep £1000 minimum in my account (to get the interest) , have never once been overdrawn and my wages get paid in every month. I pay all my bills from the account . I admit I did a bit of moving money around a couple of months ago and also made a couple of 1K cash deposits. Is there anything I can do? Oddly they have not closed my credit cards I have now opened a student bank account with HSBC and also checked my credit file. HSBC are doing a switch to move all my DD's. I have also opened another credit card that gives no charges on non sterling transactions or cash withdrawals ( I can't quite believe it as it nots Halifax). I want closure but I also want Virgin Money to pay. Sorry for the long rant
  12. Did you ever receive a letter of claim which is several sheets and asks you to say if you admit, deny the debt etc. So often claims can be seen off if you answer these correctly . I know that doesn't help you at the moment. Once more details are known more help can be given , for example sending a CCA request and a CPR 31.14 request for documents mentioned in the particulars of claim (such as the default notice).
  13. It came from another forum and the website of a solicitor advocate . I think the key point is the name of the entity that owns the debt so for example Intrum UK Limited is not the same as Intrum UK Finance Limited . It was noticeable that the case was not appealed.
  14. It was the way you wrote which was very similar to a linked in post hence my thought you had read the post. As HHJ Walden-Smith was sitting as a circuit judge , you would hope her decision would be more persuasive than a DJ or DDJ.
  15. Very true Andy. Glad to see you read the post about it. I wasn't saying a case had been won on it but the protection supplied by S78 was available for overdrafts and that the old arguments as given by Dx were no longer entirely accurate. Therefore there may be a point in sending S78 requests to overdrafts
  16. Just to be factually correct HHJ Walden-Smith did say that current accounts were subject to S78 and therefore if the creditor did not comply the account would be UE as per S78(6) CCA. I suppose it depends if you want to run the unenforecability argument and try not to get a claim or even a letter of claim or feel you have a strong enough case to defend if a claim lands on your doormat. I personally favour the former as getting a letter of claim and/or a claim form is really rather stressful.
  17. Just for the record , under certain circumstances, overdrafts do now fall under the CCA and you can send CCA requests- there is case law MFS Portfolio Limited v Phelan & West. However, most debt purchasers don't actually realise that. In my experience, RBS/Natwest are reluctant to sell on debts that are being paid- they didn't sell mine for a long time and when they did to Cabot , Cabot were unable to find the agreement.

There are lots of ways to deal with debt but before you start looking at advice think about where that advice is coming from Stepchange are essentially funded by the banks so it is in their funders interests to get you to pay back. This is in the same way that gam care is funded by the gambling industry and talk about 'responsible gambling'. For most of us there is no such thing as responsible gambling. CAB are only as good as the advisors , the same can be said for internet websites. Many of those are set up by companies who offer services where you have to pay - there are some like this one and others who do not. I didn't get into debt on purpose, it kinda happened. By the end of it I had 50K of debts and nothing to show for it. I followed the unenforceability route before it was fashionable (people were saying using paperwork errors did not work but it did ). I am now debt free. I don't feel guilty - I had so much debt yet they fell over themselves to lend me more As for bank accounts I have several, some of which I really should close but two of them offer fee free transactions in Europe and another came with a fee free credit card (for overseas purchases) with an APR of 9.9%. So now my money gets paid into my B account , each week I transfer spends into ny Starling account . All I have now is 60K of student debt that is very unlikely ever to be repaid

  21. My view is it happens and it is how they deal with it that matters. I have used ASDA, Tesco and Sainsbury for deliveries based usually on who has slots available. Non have been perfect but all have refunded for errors. During the first lockdown ASDA would not take substitutions back but would refund if they were unacceptable . Just check the delivery off and contact them if there is a problem However I have found Morrisons customer service to be less than stellar.
  22. I think there might be a difference between means tested benefits and other welfare payments. However unless either you agree, or a court orders then no payments can be forced.
  23. Not the first company to be working from home. My payroll department now send out payslips electronically. Mind you I would give them what they ask for, at the moment it is unenforceable
  24. Sorry I can’t read it all properly but If it was unenforceable then, why would you send another cca? Of course if it was enforceable then yes send another. Do you have a Default Notice? I had a vanquis card from those days and Lowell closed the account although the agreement looked good( but the DN was bad).
