I still have to be convinced as to the validity of a NOA by email. I personally believe that because of the transient nature of email and the wording of the LPA post is the minimum way to serve both DN's and NOA's. I do not however know if it has come up in a case yet. Maybe it is something we could ask

I think that with the changes in regulations etc we have to be aware that just because someone did it before doesn't mean they still do it. For example 1st Credit was taken to task for using SD's as a debt collection tool, I don't believe they use them as such anymore. Same with Lowlife

 

Of course MMF are in my opinion , complete arses.

Hi I've received exactly the same email as this today. I haven't bothered to reply to it (or any of the others) as that email address is one I seldom use. I was under the impression that mm cannot register the default only the actual creditor. Confirmation of this by someone would be appreciated. Thanks. On a slightly lighter note. I was attending an appointment this morning but my son was visiting to do some painting. The phone rang so he answered it asked who was calling & was told mm. He promptly told them I didn't drive or have a car so I wouldn't be interested in any car finance package. He then hung up.

All DCAs NOAs are generic templates, add debtors name and address, name OC name amount OD, state we bought it on etc.

The followed by the individual " Company Threat Scrip".

 

 

I will say that as has been said earlier the NOAs are genuine I've not seen one case of a company issuing and NOA for a debt they do not own, nor have I seen any creditor saying that a debt has been sold to a DPC when it hasn't.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

This is an old debt from 2010 that was passed to a debt management firm to deal with when I got divorced

& a set of bills appeared in my name the ex had made with my card details.

 

Not heard anything from PTPD .

 

. .then MMF appeared with it

 

... I think I will have to set up a pay plan with them to stop the process going any further

 

.. unless there is another way?

 

its no where near 6 years old either.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As far as several of us are aware MMF are debt purchasers and although maybe not often they do issue claims in the courts . I am not suggesting anyone roles over and pays, god knows I hate them but we need to be prepared to defend and do what is necessary . That may mean coming to a payment plan.

 

You are of course right they are not bailiffs and can not come and take property but they can issue claims that, if not handled correctly could have unfortunate consequences

As I have mentioned in my previous messages, I do not want a visit to the property, I have put forward a possible solution & would like feedback on this from yourselves.

Any unannounced arrival will not be allowed on to the property, and your agents will be asked to leave. If you keep threatening me I will escalate this to the FCA & Ombudsman citing harassment and improper conduct on your part.

As for costs I will be sending invoices to you at a rate of £50 per email I have sent and £75 for each letter I have sent, as well as Doorstep visits being charged according to amount of time.

I have put a reasonable request forward in the way of payments and wish nothing more than a reasonable reply in the matter, I wait with anticipation for a response to my question.

Use the library and use the proper doorstep letter and send signed for mail. Keep receipt and tracking info proving delevry.

 

that letter tells them that any visit from them will be tresspass and you will dial 999

The letter charges wont hold any weight. But it MIGHT cause them to think twice.

 

Just remember as well that the emails are pretty much all automated and you can tell which ones have been written by an actual person.

I would send it by email as well to the various email addresses. I would mention as well the CSA (credit services association ) code of conduct that states that where possible they must inform you of a date and time of visit. So whatever they try to say an unannounced visit is not allowed.

 

As for the charges , they probably will not do any good BUT there are some cases where people have made court claims against DCA's and won by default. In one case I know of the DCA then went for a set aside but at the last minute paid up the £500 . Of course my view is that someone probably made a mistake and the cost of them applying for the set aside would be more than £500.

If you want to make an off in F&F negotiate start at no more than 10% of the outstanding balance make it conditional on marking CRA files as "settled".

MMF's emails are automated. Personally, the only offer i would make is not to report them to the regulators or take them to court for harassment and constant breach of regulation and law, providing they write off the debt, or stop contacting you.

I really do hate saying this but since I started the complaint I have only had one set of contact (two phones and 1 txt in the space of 3 minutes). Not heard from them for 10 days now apart from a half arsed answer to my complaint which I responded to.

 

Maybe, just maybe they are starting to learn. I hope that it isn't confined to people who stand up for themselves.
