Loan was due yesterday 1st May. Emailed customersupport@ paydayexpress .co.uk on 30th April and then that address yesterday along with loan.agreements@ paydayexpress .co.uk, concerning the possibility of starting a repayment plan. No reply from either. Had phone calls but not answered as don't want to be intimidated by them on the phone.

 

Does anyone have any other email addresses of theirs that will get a quicker response?

Don't be intimidated by these numpties and good work staying off the phone. Payday Express (read some of the threads) are difficult to gain a response. Don't be afraid to lodge a formal complaint and raise their conduct with OFT and FOS should they not play ball.

Hi here's an update

 

Eventually recieved email from ef-hardship @ expressfin.co.uk. said the usual about only reasons they can accept repayment plans, illness etc.

 

Have replied with my information. Nothing too detailed, income expenditure and what I owe other payday loans.

Log a formal complaint re the phone harassment. They've 8 weeks to respond before you can contact FOS. In the interim, let OFT know straight away what they're up to. Payday Express seem to feel rules don't apply to them.

If you've already lodged a formal complaint, there's no need to write again. In my experience, I did keep reminding them of their responsibilities/timescales for responding and received calls regardless.

 

That said, there's no real harm in doing so reminding Payday Express that the clock is ticking and unless they play ball, they'll have to explain to FOS their actions as part of a formal investigation and their bill to pay!

Don't phone them at all; you've stated clearly your reasonable intention to correspond solely in writing so you have a valid and timely method of evidence for your complaints to the regulator. If the numpties have a problem with this, tough.

 

You pay these people what you can afford, not what they think you can. They can shout and rant as much as they like; priority debts come first (link below).

I'd be tempted to reply to their e-mail confirming you've already responded and remind them of the timescales of their complaint investigation.

Email them and state that you will NOT and will NEVER call them by telephone. State outright that it is your LEGAL right to have everything in written format for your own records. Also tell them that by ignoring your written instruction to correspond in writing and for them to try to pressure you into calling them, they are in breach of OFT guidance on debt collection and they WILL be reported to the OFT with a comment on their fitness to hold a credit licence. If they call you after they receive the instruction not to call you, full complaints will be made to the regulators and to OFCOM.

 

Don't mention any payment arrangements in the email. You already sent one about that. Just reply direct to the quoted part above.

 

Once thing to add, is that if this is the first default fee, then unfortunately it is justified. However, they cannot levy any more default fee's or late payment fee's on the debt, no matter what excuse they try and use.

 

Since they think regulation and guidance do not apply to them, i think it's time we played hardball with them.

Although I will say in email that I have already sent them my proposed payment arrangements?

 

Surely these financial difficulties agents have there own email addresses to keep in contact with you without having to speak to them on the phone.

Nope. Thats how PDL's operate. They are the lowest of the low.

Silly idiots. Wonder if they realise that they could lose their licence for that.
