Hi All

 

I have a similar summons to above also from Excel via Bawtry. To be clear, and I have checked with the Court, the summons has been issued on behalf of Excel, not Bawtry. According to the VCS case, Excel have no legal authority to chase via the courts - only BTC could sue for trespass if they so wished. Is that not correct?

Not looking to avoid payment of parking charges. Actually paid but ticket was wrong way up in window. Shown to attendant who accepted it was valid but insisted on ticket.

If it's a Magistrates court summons rather than county court papers then you've been charged with a criminal offence under the Road Traffic Regulation Act of parking in breach of a Parking Place Order. The VCS case, which related to the civil matters of trespass and contract law, has no relevance as you're not bring sued for trespass or breach of contract. If the situation is the same as in the other thread then there do seem to be questions about whether Excel actually have the authority to issue ECNs on behalf of Bawtry Council and whether there crappy paperwork complies with the requirements of the RTRA, but don't get sidetracked by the VCS case which concerned very different points of law.

Before ANY advice is issued on this, are you prepared to attend court and plead not guilty ?

That is if excell dont throw the towel at the last minute.
