I made a formal complaint by email yesterday to robinway, due to receiving a doorstep collector from Robinway Way on Bank Holiday, as I was not in the doorstep collector disclosed full details of the account to a third party in the house. Also she brought her young kid 6-8 yr with her??

 

I sent a formal complaint by email yesterday. I going to prepare a revised complaint.

 

Today, Bank Holiday Sunday the same person knocked on the door again. I did not open, but she made a bit of a scene my swearing her head off as she walked to her car door. I sent her a quick text message quoting the common law, and further actions will be reported to the police, OFT, FOS. She tried to call back on my mobile phone, but I ignored it. [ hopefully that will do the trick]

 

I going to send another complaint regarding her behaviour.

 

The account is for a old capital one card account, originally I was just going to pay the whole thing off as I had been out of work for so long, just got a confirmed contract...so If Cabot has just been a little bit more patience, But I'm now going to dispute the whole account full of charges 2/3 are charges.

 

Hope every is having a lovely Bank Holiday weekend BTW.

all those charges are a PENALTY and you can get them back + interest they levied on them.

Yes, this is on my CRA file, I'm surprised to as the amount is around £300, and around £200 of that are charges.

 

Can DCA do doorsteps on Saturdays/ Sundays? particularly Bank Hoildays, not like I can run down to the bank when every thing is closed.

Strictly speaking yesterday (Saturday) was not a Bank Holiday, neither is today (Sunday). Although I'm not sure if there are any rules about calling on a Sunday, I've got a feeling they're not allowed to.

 

At least if your doorstep goes missing anytime soon you'll have a suspect in mind! :wink:

Actually I feel a little bit sorry for these doorstep collectors. Most are self employed and they don't even have their expenses ( e.g. petrol costs) refunded to them. So this poor women may have been driving around your area for hours today, without even getting paid a penny. sad.gif

 

She was probably swearing her head off, because she was a little bit fed up and nothing to do with you not wanting to speak to her. Perhaps in readiness for her next visit, you can get some local job adverts cut out from the local paper or details of the local Job Centre plus to hand to her. icon3.png

Shouldnt feel sorry for them in the slightest. They know EXACTLY what they are doing and what they got themselves into when they took the job.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

More people are becoming aware of their rights. In the past there were fewer sources of info other than the CAB and some other advice centres.

 

The banks have to try to distance themselves from really dodgy collection techniques - but its OK to get a third party to do it - and the dodgier they are the more that age old fear factor can be enforced.

VERY LUCRATIVE job.

 

i know one gent that used to collect on debts

but 'mixed' this with SB'ed stuff himself

 

made over £8k a month to his pocket

as people knew no different than the cough up!

in addition to the above - they have NO right to call at your home without your prior consent on ANY day (OFT Guidelines).

I live in a run down part of London, so when these people get a list of addresses to collect from they must do their homework on where to collect from.

Unless you are a Jehovas ' witness or a friend or family you dont go knocking on doors unannounced, very risky good luck to them. Imagine wandering around a council estate collecting money !

I've sent several doorsteppers packing from where I live, a large block of mostly privately owned flats, in a good road... one got very aggressive with me and told me I was 'interfering with the processes of the law'. I said if it was that important they could talk to the Managing Agent and got him on my mobile phone, the doorstepper had a brief conversation and walked off in a right huff. Turned out the person he wanted had already been repossessed and was no longer a resident.

 

I think the tactics they use are not on, especially if somebody hasn't found out that they do have rights, and can refuse them entry without being immediately carted off to jail.

 

Another DCA continually advertises in one of the free papers, Metro, for high commission only collectors, and they state you must have a car, pay for your own petrol, phone costs etc etc, they also state 'extensive training available'. As I don't drive I can't take up their offer bnt it would be interesting to see what 'extensive training' is available to the collectors.

 

It would also be interesting to see where they store the doorsteps they collect.

Hey Guys

 

Just been reading some of the posts with regards to Robbers way and there door step challange. Any DCA that has had no prior consent from the debtor to make a doorstep visit is in breach of the

OFT

’s Guidance on sections 77, 78, 79 of the Consumer Credit Act 1974 - the duty to give information to debtors and the consequences of non-compliance on the enforceability of the agreement.

 

If the debtor has disputed any such alleged debt being owed to the DCA in question then the DCA has no legal rights to carry such action.. This could be seen as harrassment .

 

Ive had dealings with Robinson Way Limited and also find it strange that they have sent someone out. Do not give in to these idiots. Collect all the evidence and send all copies of your letters and there letters including any copies of phone bills and send them to the OFT and The Financail Ombudsman and make it a formal complaint. Inform Robinson way limited of your intent and inform them that you will no longer have any contact with them until you have had a response from the OFT and The Financail Ombudsman. If you disputed any such debt right from the start, then this will go in your favour. If they keep sending you letters threatening you with anything, send copies of these off to add wait to your complaint.

Not surprised with Robinways response, the agent basically lied that she never turned up on a Sunday, that they never received my text message to their mobile phone, and they never called back my Mobile phone on a Sunday. And have requested I write to them within the next 14 days to offer a payment proposal.

 

 

 

ETA : I just going to pay slightly under the amount excluding charges directly to the OC, and dispute the rest of charges. I don't have the time to prepare a case based on 'she said vs you said argument".

If you feel that you have been treated unfairly by Robinson Way limited and that you feel that you have been harassed by them then complain to the Financail Ombudsman and OFT and make a formal complaint.

 

It is worth it. I made a formal complaint against Robinson Way Limited and won. Got some compo and they were forced to remove the default from the credit file. I also made a formal complaint to the OFT and they ruled that ALL information was relevent wether it be either a credit agreement or a service ie; mobile phone or utilities in all case's where proof is requested that the alleged debt exists.

 

If a debt company cannot prove it within the time frame allowed, then you can assume the debt dose not exist or is Statute Barred and its just a company trying to make a quick buck by idle threats.

your all lucky, poor Mrs ex-hippy was told she had to get a court order to stop them visiting,, see my thread DCA Collections are above the law... Now they had a lovely letter back with the help of Bazooka Boo !!!!!!!!! sent it to OFT they are investigating., won't hold me breath.
